The Madras High Court on Wednesday dismissed an anticipatory bail application by Alex C. Joseph of Kerala, who is wanted by the CBI in a case relating to the import of luxury cars in 2008, allegedly in violation of the Customs Act.

Justice B. Rajendran passed the order on a petition by Mr. Joseph (51) of Thiruvalla, Pathanamthitta, Kerala.

The petitioner submitted that he had been cited as the second accused in the case, the first accused being a Senior Intelligence Officer (SIO) of the Directorate of Revenue Intelligence (DRI.) The FIR, registered for alleged offences including cheating and forgery, said the agency received intelligence that on March 6, 2008 the petitioner had imported luxury vehicles and the SIO had not conducted the investigation properly. After a lapse of two years, the FIR spoke about specific intelligence by DRI on April 28 last year on import of certain luxury vehicles. It, thereafter, said the petitioner was instrumental for the import of 33 vehicles.

The presence of Mr.Joseph was essential to find out his role and the role of other accused in the case. Hence, the petitioner should not be granted advance bail, the counter said.
