Plea filed only for his appearance in court, says APP

The Melur Judicial Magistrate court on Friday reserved orders on a petition filed by the Madurai rural district police seeking a non-bailable warrant against Durai alias Dayanithi Alagiri, son of Union Minister M. K. Alagiri, former director, and Nagaraj, partner, Olympus Granites, in the granite scam case.

Magistrate V. Jayakumar, who heard arguments, put off the decision to Monday.

Arguing against the counter petition filed on behalf of Mr. Dayanithi, Assistant Public Prosecutor S. Selvasundari said the petition seeking warrant had been filed only to press his appearance in court and not for investigation. The High Court had not directed Mr. Dayanithi to appear before the police while dismissing his first advance bail petition, but this did not mean that he could remain in hiding. She refuted the allegation of infringement of fundamental rights.

On the contention that the court could not assume the role of the investigation agency, the APP said that the issue of warrant was similar to recording a statement under Section 164 of the Cr. P. C. The Deputy Superintendent of Police, Prohibition Enforcement Wing, had filed the petition for a non-bailable warrant since he did not have powers as investigation officer to compel a person evading arrest to surrender.

The defence lawyers argued that a non-bailable warrant was issued only in long pending cases after filing of charge sheet and not in a case like this where the investigation was in a preliminary state.

HC adjourns hearing

The Madras High Court Bench here adjourned to Monday the hearing on an anticipatory bail application filed by Mr. Dayanithi in a case registered by the Keezhavalavu police.

Justice T. Mathivanan deferred the hearing following a request made by the prosecution to enable Advocate General A. Navaneethakrishnan to oppose the advance bail application.

This is the second application filed by Mr. Dayanithi. The earlier one was dismissed by the same judge on September 25.

‘Pottu’ Suresh quizzed

Dravida Munnetra Kazhagam functionary and Mr. Alagiri’s close associate, ‘Pottu’ Suresh alias Suresh Babu, appeared before the Madurai district police on Friday.

According to reliable sources, the police quizzed him for over three hours on various issues ranging from the whereabouts of Mr. Dayanidhi and related business deals.

A year back, ‘Pottu’ Suresh was arrested in a number of land grab charges and detained under Goondas Act. He was not available when the police visited his house in TVS Nagar recently.

A senior police officer said that they interrogated and let him off.
