The Madras High Court Bench here on Monday stayed all further proceedings in a case pending against film actor C. Kushbu (40) and a Dravida Munnetra Kazhagam candidate for the Assembly elections held last year, K. Vijayan (44), before the District Munsif-cum-Judicial Magistrate court at Natham in Dindigul district.
Passing interim orders in a joint petition filed by the accused, Justice T. Sudanthiram also dispensed with their appearance before the lower court until further orders.
According to the petitioners, the case was originally registered under Sections 143 (punishment for unlawful assembly) and 188 (disobedience to order duly promulgated by public servant) of the Indian Penal Code (IPC) when they were on an election campaign at Natham in April last year.
They were accused of using loudspeakers and causing disturbance to the public and violating the election code.
However, after investigation, the police filed a charge sheet against them under Sections 143 and 290 (punishment for public nuisance) of the IPC.
The petitioners alleged that the case had been foisted against them due to political motives and with the sole interest of harassing them.
