Janata Party chief Subramanian Swamy on Tuesday told a Tis Hazari court, looking into his complaint on the 2G spectrum scam, that his investigation had revealed that Etisalat DB promoter Shahid Usman Balwa was “running an illegal private airport at Palanpur in Banaskantha district of Gujarat” from where he hails.

The airport, he said, was being used by Balwa and “all kinds of VIPs and criminals” to enter and leave the country without informing the authorities.

Special Judge (CBI) Pradeep Chaddah had earlier stayed further proceedings in the complaint as per Section 210 of the Criminal Procedure Code and called for a detailed report from the CBI, asking it to state whether the national security aspect was being covered by the probe into the spectrum scam.

However, the CBI investigating officer in his report submitted on Tuesday sidestepped the question by answering that he was “not aware of the details of national security aspects raised by the petitioner” as a copy of the complaint was not made available to him. Dr. Swamy said he would immediately provide the agency with a copy of his 375-page complaint and said the investigation was proceeding on a “narrow scope.”The CBI also prayed that the proceedings in Dr. Swamy's complaint be stayed and transferred to the Patiala House court of Special Judge (CBI) O.P. Saini, who has been hearing all matters pertaining to search and arrest warrants, police and judicial custody and bail applications in the case.

Opposing this, Dr. Swamy informed Mr. Chaddah that he was moving the Supreme Court on March 1 seeking a direction to transfer all proceedings and filing of the charge sheet in the spectrum case to Mr. Chaddah's court — as this was where he had filed his complaint, his complaint had a wider sweep, including the question of national security.
