In the Mysore High Court on July 1, the Chief Justice, Mr. S.R. Das Gupta and Mr. Justice A.R. Somnath Aiyar held that Sections 38, 41 and 42 of the Madras Hindu Religious and Charitable Endowments Act, which enabled the deputy commissioner and the area committee to appoint and remove the trustees of religious institutions, violated Article 26 of the Constitution as it infringed the right of religious denominations to administer their religious institutions.
