Directs Centre to set up special court for the trial

The Supreme Court on Friday held that the State of Kerala had no jurisdiction to investigate into the Italian marines shooting incident on February 15, 2012 in which two fishermen were killed and said only the Union of India had jurisdiction to proceed with the investigation and trial of the two marines.

A Bench of Chief Justice Altamas Kabir and J. Chelameswar in two concurring judgments directed the Centre, in consultation with the Chief Justice of India, to set up a Special Court to try the two marines Massimilano Latorre and Salvatore Girone who are the accused in this case. The Italian marines will now report to the Station House Officer of the Chanakayapuri Police Station, New Delhi, once a week. But they shall not leave the precincts of Delhi without taking permission from the Special Court.

After moving to Delhi, the Italian embassy can request to take control of the marines. The Italian Embassy, in Delhi, will then be responsible for the movements of the petitioners and to ensure that they report to the trial court.
