The Central Bureau of Investigation opposed the bail application plea moved by Etisalat DB promoter Shahid Balwa at a special court here on Tuesday. The agency noted that the prima facie case against him had to be considered before enlarging him on bail.
Counsel for Mr. Balwa Majid Memon said the infringement on the personal liberty of his client had to stop. Mr. Memon said his client had no other cases pending against him, was available to the CBI at all times during the course of the investigation, had not fled the country and was now open to any restrictions the court wanted to place on him, so that he may be eligible for bail. Special Public Prosecutor U.U. Lalit, appearing for the CBI, emphasised that facets of the prima facie case — including the gravity of the offence, the role attributed to the accused person and the material presented as evidence by the accused — were not being entered into by the defence in their bail plea.
Mr. Memon said several documents supporting his client's contention in the 2G spectrum scam case were now available, but were being held back to be used at a later stage. Hearing on bail plea will resume on Wednesday.
