CMC Vellore not under SWS, T.N. tells S.C.

NEW DELHI June 18. The Tamil Nadu Government has informed the Supreme Court that there would be no counselling till June 30 for the Christian Medical College, Vellore under the single window system.

This undertaking was given on Monday by senior counsel for Tamil Nadu, C.S. Vaidyanathan, before a vacation Bench, comprising R.C. Lahoti and Brijesh Kumar, during the hearing of a writ petition from CMC challenging the State Government's order asking it to reserve 40 per cent of the seats for admission through SWS and 60 per cent by the college itself.

The Bench recorded the submission and adjourned the matter to June 26.

In its petition, CMC contended that after the Supreme Court pronounced its judgment on the admission procedure for minority educational institutions, the State Government passed an order on May 14 directing CMC to admit 40 per cent of the students on the basis of common entrance test conducted by the Tamil Nadu Government and the rest by the management.

The G.O. further said that even in the remaining 60 per cent the college should follow the rules of reservation, which meant that only 11 out of the total 60 seats could be admitted by the management ``making a mockery of the Constitutional rights guaranteed to the petitioner.''

The petitioner contended that the Government had no right to compel the college to fill 40 per cent of the seats through SWS as it would constitute gross interference with the rights of the institution as a private, unaided, minority, non-capitation fee college. The college sought a direction to quash the G.O. dated May 14 and the consequent letter dated May 24.

Meanwhile, the vacation Bench has issued notice to the State Government on a similar writ petition from Meenakshi Ammal Trust, Chennai, running (Telugu minority) dental, medical and para-medical colleges and associated institutions, challenging the G.O. stipulating that it should fill 40 per cent of seats through SWS.

The Bench directed that this petition be listed for hearing on June 26 along with the petition from CMC.
