Mahadev urges Governor to dismiss Mysore varsity VC

MYSORE April 25. The Mysore University Syndicate member, K.Mahadev, today urged the Governor, T.N.Chaturvedi, to dismiss the Vice-Chancellor, S.N.Hegde, and order the suspension of the Chairman of the Department of Business Administration, B.R.Ananthan, after the Lokayukta's indictment of them on corruption charges.

In a press release here, Dr. Mahadev, who had levelled allegations of irregularities against Prof. Hegde, said the Governor, who is the Chancellor of the university, was vested with powers under the Karnataka State Universities Act 2000 to order the removal of a vice-chancellor.

Quoting Section 14 (7) (8) of the Act, Dr. Mahadev said the Vice-Chancellor could be removed by an order of the Chancellor on the ground of wilful omission or refusal to carry out the provisions of the Act or for abuse of powers vested in him after getting the report of an inquiry by a retired judge of the High Court or Supreme Court.

"This has been fulfilled since the inquiry has been conducted by the highest investigating authority, the Lokayukta, Justice N.Venkatachala." Hence, Dr. Mahadev urged the Governor to dismiss Prof. Hegde immediately and save the reputation of the university.

He noted that the Lokayukta, after indicting Prof. Hegde, had recommended that he should not be allowed to hold the post.

"Under Section 8 (4) of the KSU Act 2000, the Chancellor, soon after receipt of the report, should record his findings thereon and send the same to the State Government for taking further action as may be necessary or directed by him."

Dr. Mahadev also quoted Section 14 of the Lokayukta Act under the heading "Initiation of prosecution," which says that "if after investigation into any complaint, the Lokayukta or an Upalokayukta is satisfied that the public servant has committed any criminal offence and should be prosecuted in a court of law for such an offence, then, he may pass an order to that effect and initiate prosecution of the public servant concerned and if prior sanction of any authority is required for such prosecution, then, notwithstanding anything contained in any law, such sanction shall be deemed to have been granted by the appropriate authority on the date of such order."

The Lokayukta had indicted Prof. Hegde for demanding and accepting $ 7,000 from the late Ramadas, Chairman of TTL College, in July 2001 in return for using his authority and influence in securing permanent affiliation of the college to the university, starting a B.Com course, and increasing the intake of the college.

The Lokayukta had also indicted Prof. Ananthan for "unlawful" gain by receiving Rs. 1.64 lakh from the TTL College management for guiding 41 students of the college on their research project.

Our Bangalore Staff Reporter writes:

B. Somashekar, JD (U) MLA and former Education Minister, has said that Prof. Hegde "should resign immediately."

That Prof. Hegde was "holding on to his post even after being indicted by the Lokayukta on corruption charges," was "most unbecoming of the position of a vice-chancellor," Mr. Somashekar said.
