Fixing May 5 for taking the two bail applications for hearing, Justice R.C. Chopra directed the Ghaziabad police to file a reply to the petitions before the next date. In their bail applications filed through K.N. Balagopal and G.K. Bharati, the accused sought the relief mainly on the ground that no case was made out against them. Appearing for Vikas Yadav, Mr. Balagopal said that the prosecution witnesses examined so far had identified neither Vikas Yadav nor Vishal Yadav. He further said that the forensic expert who examined the weapon of offence (hammer) had said in his deposition before the court that the injury which caused the death of Nitish Katara could not be caused by this weapon. He further submitted that there were a lot of discrepancies in the fingerprints lifted from the body of Nitish Katara. The case is being tried by the Special Judge, S.N. Dhingra, on a day-to-day basis. It was transferred to the Delhi court on a direction by the Supreme Court.
