POTA petitions' hearing begins

NEW DELHI APRIL 2. Arguments began today in the Supreme Court in the three petitions, including the one filed by the MDMK leader, Vaiko, challenging the constitutional validity of the Prevention of Terrorism Act (POTA).

While Mr. Vaiko had questioned the validity of Sec. 21 of the Act under which he was arrested on July 11 last, the People's Union for Civil Liberties and the All-India Human Rights and Social Justice Front had questioned the validity of the entire Act.

Senior counsel for PUCL, Rajinder Sachar, today gave a brief outline before a Bench comprising Justice S. Rajendra Babu and Justice G.P. Mathur as to how various provisions were violative of the Constitution. He also contended that the law lacked legislative competence and violated the international covenants. He will continue his arguments tomorrow.
