A Bench, comprising Justice S. Rajendra Babu and Justice G.P. Mathur, remitted the matter back to the High Court, for disposal of all the cases in accordance with a 11-Judge bench judgment of the apex court in the `minorities case'. The Bench also vacated an interim order passed last year by which the University Grants Commission (UGC) was directed to hold an all-India entrance test for admission in engineering/medicine in the deemed universities in Tamil Nadu for the academic year 2002-2003. By an order dated July 3, 2001, the State Government asked five deemed universities to admit students on the basis of SWS. A Division Bench of the Madras High Court upheld the order on August 6, 2001. SLPs were filed against this order by the Shanmugha Arts, Science, Technology and Research Academy (SASTRA), the Vellore Institute of Technology, the Ramachandra Medical College and Research Institute and two others. Senior counsel, Kapil Sibal, appearing for one of the deemed universities, submitted that in the light of the 11-Judge bench decision, the matter might be remitted back to the High Court.Senior counsel, K. Subramanian, appearing for the Sri Chandrasekharendra Saraswati Maha Vidyalaya, Kancheepuram, argued that the High Court had upheld the State Government's order relying on the scheme in the `Unnikrishnan case' and since that scheme had been declared unconstitutional by the 11-Judge bench judgment, all the cases might be remitted back to the High Court.
