HC ruling on KER

Kochi March 11. A Full Bench of the Kerala High Court on Tuesday held that a teacher transferred from one school to another school under a different management did not lose his service rendered in the previous school and the service put in the previous school could be regarded as part of continuous service for getting promotion to the posts of headmaster.

The Bench comprising the Chief Justice J. L. Gupta, Justice Cyriac Joseph and Justice K.S. Radhakrishnan held that as per the provisions of the Kerala Education Rules (KER), it was clear that service put in by a teacher need not be in one unit or in the same school under the same management.

The court made the ruling while allowing a writ petition filed by V. Sasidharan Nair, teacher in the I.O. High School, Edavanna, Malappuram.
