Mr. Ilamvazhuthi was arrested on February 1 after the Assembly had passed a resolution on January 30 recommending initiation of criminal proceedings against him, allegedly for threatening and attempting to assault the Tamil Maanila Kamaraj Congress MLA, D. Kumaradas. He is facing charges under Section 307 (attempt to murder) IPC. Today, Justice P.D. Dinakaran granted bail and asked Mr. Ilamvazhuthi to execute a personal bond for Rs. 10,000 to the satisfaction of XVI metropolitan magistrate. He should make himself available for interrogation as and when required. He should not leave the jurisdiction police limits without prior permission. The judge also cautioned the MLA against attempting to tamper with evidence and influencing witnesses.
Magnetic beds case
In another case, Justice C. Nagappan set aside an order by the principal sessions judge, A.R. Ramalingam, granting anticipatory bail to a promoter of the multilevel marketing company, V-Can Network, stating he `had not dealt with the matter in the proper perspective'. (The PSJ, on January 29, granted anticipatory bail to R. Radhakrishnan, managing director of the company selling magnetic beds and other things.) "The larger interests of the public and State demand that in economic offences, the discretion to grant anticipatory bail under Section 438 of Cr.P.C be exercised with the utmost care and caution. The State has come out with this petition seeking cancellation of anticipatory bail on the ground that more than one lakh persons have been cheated to the tune of Rs. 10 crores. Custodial interrogation of the promoter, who is the main accused, has to be done and there is a reasonable apprehension in the investigating agency of the possibility of his tampering with witnesses and evidence, since he is influential and affluent". Stating that the PSJ did not deal with prosecution objections, Mr. Justice Nagappan observed: "Taking an overall view of the circumstances of the case, I am of the view that this petition (seeking cancellation of anticipatory bail) deserves acceptance".
