The Division Bench held that the fee structure embodied in the Kerala Unaided Professional Colleges (admission of students and fixation of fees) regulations, 2002 as `arbitrary' and `illegal'. The Bench, comprising the Chief Justice, J. L. Gupta, and the Justice, M. Ramachandran, also directed the Government to restrict the reservation of the merit quota of seats at 25 per cent in the two unaided medical colleges in the State. The Court was of the view that the reservation of 50 per cent as Government quota was invalid in the light of the Supreme Court ruling in the PMA Pai Foundation case. The Court was partly allowing two writ petitions filed by the Pushpagiri Medical Society of Thiruvalla and the Malankara Orthodox Syrian Church Medical Mission, Kolencherry, challenging the Government Order dated December 19, 2002 fixing regulations for the admission and payment of fees in the unaided medical colleges. In the regulation, the Government fixed a maximum of Rs. 28,750 as tuition fee and special fee, per student in an year. The order stated that 50 per cent of the students admitted should be from the list prepared by the Commissioner of Entrance Examinations.
