According to reliable sources, the CJI today received a communication from the Centre, requesting him to suggest a suitable person to continue the probe into the expose made in the Tehelka tapes. However, the CJI is reported to be of the view that there is no necessity for the Government to consult the CJI while appointing a retired judge. Though he has not taken a final decision, it is likely that he may ask the Government to appoint a person of its choice. Sources say that consultation is based on the healthy convention so that the CJI could recommend a person suitable for the job. But in view of the controversy and criticism in certain quarters that the then CJI ought not to have recommended Mr. Venkataswami's name for the second post, when he was already holding the post of Chairman of the Tehelka panel, the CJI does not want to bring the office of the CJI into another controversy. The CJI is likely to reply to the Centre's request in a day or two conveying his decision, say the sources.
