Declare strike illegal: petition

CHENNAI OCT. 22. The Madras High Court has ordered notice to the Government on a petition seeking to declare the `indefinite strike' by various government employees unions, scheduled to commence tomorrow, illegal and unconstitutional. According to the petitioner, R. Rajasekaran, as teachers and government staff came within the ambit of the definition `government servant' under Rule 2(3) of the Tamil Nadu Government Servants Conduct Rules 1973, they were specifically barred from participating in or inciting strikes. There was no fundamental right to strike and the proposed agitation would severely affect routine life in the State, besides imposing a huge loss on the exchequer.

The industrial jurisprudence empowered the Government to prohibit the strike if it would affect the public utility services, he said.

He prayed for a direction to the State Government to take appropriate action prohibiting the proposed strike.
