`Purchase not made in public interest is offence'

CHENNAI, DEC. 8. The Janata Party president, Dr. Subramanian Swamy, today expressed the hope that he would succeed in his appeal in the TANSI land deal cases before the Supreme Court.
Despite the High Court judgment, Dr.Swamy said that under Section 13 1 (d) of the Prevention of Corruption Act, even if Ms.Jayalalithaa, former Chief Minister, had paid the full amount for the property, a purchase not made in the public interest was an offence. As for the verdict that the Code of Conduct was not law, Dr. Swamy said it was a subordinate legislation for the conduct of business by the Government as per the Constitution.
On the Prevention of Terrorism Ordinance, Dr. Swamy told presspersons here that any law including the Indian Penal Code could be misused. But that could not be held against the legislation. In this connection, he claimed that Ms. Jayalalithaa, while supporting the POTO, was siding with the Dravidar Kazhagam. ``She is always inconsistent. She talks about secularism, but speaks to VHP leaders''.
Dr.Swamy said his stand that Ms.Jayalalithaa could not stand up for the nation's integrity was vindicated by her outburst yesterday against the demolition of the Periyar Centre in New Delhi by the Delhi Development Authority .It was functioning as a support centre for LTTE activities.
Dr. Swamy said his public interest litigation petition on the Mullaperiyar dam issue would come up for hearing next week. Kerala was delaying the inevitable raising of the water level to 152 feet. He said the Antony Government decision to get the opinion of international experts ``was anti-national... Aren't there enough experts in India'' ?
