Pillai move to seek bail in SC

THIRUVANANTHAPURAM, MARCH 9. The former Minister, Mr. R. Balakrishna Pillai, and the former KSEB Chairman, Mr. Kesava Pillai, are likely to file a Special Leave Petition (SLP) in the Supreme Court on March 12 against their sentence by the Vigilance Special Court in the first module of the Graphite case.

According to legal sources, the Supreme Court would normally admit the SLP after the convicted persons produce the certificate proving that they have surrendered and undergone imprisonment at least for one day.

The delay of more than a week in the execution of the arrest warrant may also be taken into consideration by the apex court when the bail application is moved, sources said. It was on March 2 that the High Court confirmed the trial court sentence against Mr. Balakrishna Pillai and Mr. Kesava Pillai.

The Vigilance S.P., Mr. Nitin Agarwal, who has been asked to execute the warrant against the convicted persons, can technically effect their arrest anywhere in the country. The team has reportedly received definite information that the convicted persons are in Delhi.

Meanwhile, the Kerala Congress(B) general secretary, Mr. C. Venugopalan Nair, said in statement here today that the party chairman, Mr. Balakrishna Pillai, was in Delhi and that he would remain there till the reopening of the apex court after the Holi vacation on March 12.

Charging that Mr. Pillai was the victim of a ``political conspiracy'' of the Nayanar Government, the statement said the party chairman would prove his innocence in the Supreme Court.
