BGML closure : HC's notice to Centre

BANGALORE, JAN. 6. Mr. Justice H.N.Narayan of the Karnataka High Court ordered on Friday issue of notice to the Union of India, Bharat Gold Mines Limited (BGML) and other respondents in a writ petition filed by Bharat Gold Mines Officers' Association and others challenging the orders passed by the authorities proposing the closure of BGML.

The petition stated that the BIFR had passed orders on June 12, 2000 proposing that the BGML be wound up.

The petitioner had filed an appeal against the orders, which was rejected by the appellate authority on November 15, 2000.

The judge adjourned further hearing of the petition.

Status quo

Mr. Justice H.N.Narayan ordered issue of notice on Friday to the Union of India, Bharat Gold Mines Limited (BGML) and other respondents in a writ petition filed by the Bharat Gold Mines Officer's Association and others in which the petitioner had sought the circular issued with regard to the Voluntary Seperation Scheme (VSS) to be quashed.

The petition stated that the authorities had issued a circular on December 8, 2000 in respect of the Voluntary Seperation Scheme opened to all employees for a period of one month, with the last date for application being January 10, 2001.

Under the scheme, the employees were given the option of a heavy industry package or the "Gujarat Package." The employees opting for the first scheme would be paid ex-gratia and they could approach any heavy industry for appointment. The petition stated that 4,000 officers and employees had been affected. The notification was without jurisdiction and was liable to be quashed.

After hearing the counsel for the petitioner, the judge ordered that status quo be maintained and adjourned further hearing of the petition.
