The suspended IPL Commissioner, Lalit Modi, has asked the Board of Control for Cricket in India (BCCI) to provide him with a copy of the decisions/resolutions taken at the Special General Meeting of the Board which authorised the BCCI president and the secretary to take all legal actions, including civil and criminal against Mr. Modi.
Mehmood Abdi, counsel for Mr. Modi despatched a notice (on July 3) to Mr. Manohar and N. Srinivasan saying: “We address the instant notice on behalf of and on instructions of our client (Mr. Lalit Kumar Modi). Our client has instructed us to state that the SGM of the BCCI was held today in Mumbai and after the meeting a press conference was held wherein the Honorary president of the Board stated that the Board has taken the following decisions (a) That the decision of the Honorary Secretary to refer the issues raised in the show cause notices and the reply given by our client are referred to the Disciplinary Committee (b) That in view of the recusal by the Honorary president from the proceedings relating to our client, Jyotiraditya Scindia, has been appointed as the member of the Disciplinary Committee and (c) That the Board has authorised the president and the secretary to initiate all civil and criminal legal proceedings including lodging of the First Information Report before the appropriate police station.
“We by the instant notice call upon you to confirm immediately if the aforesaid decisions have been taken and if so then we further call upon you to kindly provide us with the copy of such decision or the resolutions passed by the General Body of the Board at it's Special meeting held today in Mumbai forthwith and without any further delay as the same directly impinges on and affects our client and his rights and he would like to consider his position.''
At the press conference on Saturday, Mr. Manohar said that he (and not the Secretary) has been authorised to take legal actions and that the nature of the legal action can be pursed only after determining (after a thorough legal examination) the cases that can be considered civil and criminal. “We have not yet decided what legal action can be pursued. We don't have to do anything now; it's up to the Disciplinary Committee to enquire into the charges levelled in the three show cause notices. The DC itself will issue notices. The DC will not have a chairman or convenor.”
When asked if an FIR will be filed, Mr. Manohar said: “If and when we decide.”
A senior BCCI official said, “the BCCI provides copy of resolutions adopted at general body meetings only to its member units, not to individuals. As the BCCI president said, the notice (to Lalit Modi) will be issued by the Disciplinary Committee.''
