Sibal’s proposal

Law Minister Kapil Sibal’s proposal that the government have a say in judicial appointments, if implemented, will set a bad precedent. It would be much against the principle of separation of powers enshrined so thoughtfully in the Constitution. It could seriously undermine the independence of the judiciary.

The appointment of public prosecutors and government pleaders on political and other considerations has already had a telling effect on the effective functioning of courts.
