The Supreme Court verdict quashing the National Eligibility-cum-Entrance Test (NEET) proposed by the Medical Council of India and the Dental Council of India for admission to the MBBS and BDS courses is another milestone in the sphere of judicial activism. NEET was strongly opposed by many States and State-run universities because of the different patterns of education. Aided and unaided private medical institutions also protested against the common entrance test, as it deprived them of their rights guaranteed under Article 30 of the Constitution. A common entrance will only lead to a common race among unequals.

NEET would have created a feeling of oneness and unity in India. It would have dispensed with the complexities of entrance tests. The court has struck down a progressive measure.
