Reacting to the Opposition demand for his resignation in the wake of the Madras High Court rejecting his plea for dismissal of an election petition against him, an assertive Home Minister P. Chidambaram told journalists here on Thursday: “Issues have not yet been framed, trial has not yet started and not one witness has been examined. I am astonished by the monumental ignorance displayed by certain political leaders. This is an election petition. There are 111 election petitions filed against members of 15th Lok Sabha,” he told journalists here.
He went a step further and argued that “the [High Court] verdict was not a setback to him but for his rival [AIADMK candidate Raja Kannappan of the AIADMK in the 2009 Lok Sabha elections from Sivaganga].”

Mr. Chidambaram said that in the election petition there were only allegations.
The Minister said he hoped that political leaders would read Order 6, Rule 16 of the Civil Procedure Code and understand what was the meaning of ‘strike out the pleadings'.
“If pleadings are struck out, it is a setback to the election petitioner and not to me.”
Asked about the claim of Mr. Raja Kannappan's lawyer that except paras 4 and 5, all charges in the petition had been accepted by the court, Mr. Chidambaram said “pleadings have not been accepted. Now the trial is to start.”
Replying to AIADMK chief Jayalalithaa's charge that he had moved the court out of fear of facing the case and only to delay the process, the Minister said sarcastically: “They [rivals] have not sought adjournments to the trial dozens of times. They have not approached the High Court or the Supreme Court dozens of times. Therefore, they are entitled to make these demands.”

I think , in a similar case , filed in the earlier Lok sabha 8 years
back , a defeated candidate won the case after the term of that lok
sabha had ended . The judgement in that case also came so late after
completion of 5 years of that Lok sabha . I think , it was in UTTAR
PRADESH or any other seat in North India .
Agree with Vijayan and Syed and Piyush. Everyone is quick in judging. Problem is people believe whatever reported in news is true. Now a days news is not reported, it is created.

The court should decide the case not outsiders. Jayalalitha has a very serious charges in the court of law. She should first resign and leave the politics.
it is very strange to hear such utterances from the HM who is a lawyer himself. He needs to be remember (or has he to be told?) that the instant occasion has arisen out of his arguments in the court that the petition from the other party is devoid of material facts. Out of the 25 or so allegations presented by the other party, only two allegations have been not accepted by the Court. It is significant to note that one of the allegations NOT struck down by the Court, relates to payment of Rs.500 each to thousands of women belonging to self-help groups in the constituency by the Minister's son, Karti Chidambaram, and his election agents. Perhaps, the HM is showing signs of tiredness, on account of having to face problems all around.
I agree with Vijayan and Syed. It has truly become a fashion to put up charges against anyone nowadays. And I also do feel that we, as people of India are equally responsible for the same. We become judgemental as soon as any piece of news comes our way. We never analyse what the situation is and never pause to ponder what realy is the matter. With so much news of corruption and scams, we people have started believing that whatever allegations are pressed against any person who is related to politics is bound to be true.
This arrogant man has no moral right to be the HM of the country. On his own he cannot get 100 votes. Everyone knows how he won the election. But the sad fact that judiciary has taken almost three years and in another two years he will complete his term. He knows that this will be his last term.
Its Irony that Indian media and so called educated get carried by News Sensational in nature. Lets be fair and give Chidambaram a chance to prove himself in front of the judiciary. Its high time that we should stop condemning one by merely reading a news or electronic media. Chidambaram has done a good job as the home minister of this country.He has streamlined the intelligence gathering mechanism . our home minister it self agreed that 111 petitions are pending in the court.see how he defending his case ? hat of chidambaram in another 50 years u r the home minister of our great country.
Given that PC is involved in umpteen controversies, the conclusion is he is under cloud. Right from Fairfax irregularity till now PC is caught in controversies. India can do without PC. No one is indispensable.
Mr.Chidambaram is a shameless politician . He will hang on to power at the cost of his self respect because ' power ' the ultimate corrupter has corrupted him completely . How else can you explain his behaviour ? With so many charges levelled against him , one would expect him to resign his post as Home Minister and also his membership of the Parliament . But then he would do so only if , he indeed , is honest . And again , he is no different from his colleagues in the corrupt , scam tainted UPA government . Rhetoric is all that they give us by way of explanation . The UPA has no dearth of glib spokesmen . I guess , having elected them , we have to put up with these despicable characters till 2014 general elections .
Jayalalithaa has no right to comment on the findings of the Hon'ble Court to make derogatory remarks against her bete noir:Chidambaram ! She should introspect her own life which is a legacy of far from moral living let alone the amount of wealth she has illegally stashed all over the world.
Being in the high position as Home Minister of India, it is his responsibility to come out clean soon. To that end, he should request the Chief Justice of the High Court at Chennai to hear the case against him and deliver the judgement within 3 months. The Chief Justice of Madras High Court may not ignore such a plea given that the credibility of the Union Government and its functionaries are at stake.
Thank God Mahatma Gandhi is not alive to see politicians like P Chidambaram!
Will he be considered more respectful to the judiciary by appealing against the ruling of the Madras High Court or by simply accepting the decision of the Madras High Court ? If the latter is the answer, why did he not accept the decision of the lower authorities in the first place ? Will someone throw light ? I am just being curious, though I feel one can get justice only if he has spare money and time, apart from knowing fully the loopholes in laws and the system.
Mere charges do not prove guilt. In our democracy every body is in a hurry to make his own conclusion.
@ Kumar :: Your statement defines the problem - we cannot decide on people and their actions based on how 'citizens feel'. I am also a citizen - I feel he is innocent - does not mean he is innocent. He may or may not be corrupt or deserving, but that is not any more or any less than all of the other politicians we have. Justice has to take its own course. We can't push it - that is not what our Constitution allows. So just shut it, and wait for the verdict to come, whenever that happens. You have no choice - that is the way we Indians have chosen ever since we designed our Constitution and Judiciary system to run the way it does.

Calling for resignation has become a fashion . When court wants to give an opportunity to the petioner to prove his case, it does not mean that the accused is likely to be convicted. Let us be fair to Mr.Chidambaram .

I agree with Kumar's comments and adding a point; With this kind of state of affairs and judiciary systems that we have, people of India wants to LIVE outside India rather than sucks thier lives every day with stupid ministers/mafia/criminals occupy parliament and RULE India. Now POLITICS become a BIG PROFIT BUSINESS rather than people service oriented. Judiciary/CEC/State CEC/CBI/ED etc must be independent and speed enough to save country.
if there is Prima facie evidence to start the proceedings then let the court do the same asap. Such electoral frauds have to be dealt on priority basis. Until the accusations are proved PC is just an accused and not a convict.

PC indeed has been mild in his reaction to the demands from Janata party -mining scam and jayalalitha -disproportionate assets. Certainly these people have no moral right to demand PC's resignation only because the pendancy of the election petition. It is highly ridiculous to say the High Court has accepted the allegations as claimed by the petitioner's counsel.
Mr. Kumar, kindly desist from expressing opinions on the behalf of 'majority of the citizens'. The fact is, since he took over after the grave tragedy of 26/11, Mr. Chidambaram has done a commendable job as the Union Home Minister. Mr.Chidambaram is not just an ordinary citizen, but is a Cabinet Minister in the Central Government, that too the Home Minister. The case against him pertains to the time when he was Finance Minister. When the Madurai bench of the Madras High Court on Thursday declined Mr. Chidambaram's plea for dismissal of the election petition against him, he should have resigned from the Central cabinet and fought the case only as an MP.

In India,the election cases filed in courts will decide after completion of the tenure of MLAs and MPs like the case of Cheranmahadevi MLA's case.A time limit should be fixed upto appeals in Supreme Court.Otherwise, it is one kind of mockery.
election related petitions should be disposed at the earliest.we have several instances when the final judgement takes more than 5 years when the elected candidate completes his term and the final judgement will have no real impact.Here the justice delayed is justice denied.With ever increasing electoral malpractices use of money and the recent paid news menace it is high time that we have a speed trial of these cases.Democracy is too valuable to leave it to late judgements.

Mr.Kumar, before saying something please provide facts about your allegations against the home minister.There are courts and judges for the matter.Ms.Jayalalithaa has cases against her and it still going on.It has been 17 years and no judgement yet.Please don't go by perceptions but rather by facts. The home minister is not corrupt as many people think and mostly want to think rather give evidence to that fact.We should be proud to have such a person in the Home Ministry at this juncture when safety and security of the country is essential. The HM is a well learned man and he should try to change the perceptions against him, otherwise lies can change to truth by repeating it again and again like Mr.Swamy does. Mr.Chidambaram should talk to the nation and clear all the doubts in the minds of the people may it be 2G or Elections.This atleast will put his of the facts clear in public. For the UPA-II, there appears to be no end to problems. It now has to face the wrath of its opponents following the refusal to dismiss the petition challenging Mr P Chidamabaram's election. In view of the fact that the High Court has told in no uncertain terms that PC must face the case, the Home Minister must put in his papers so as to uphold the true democratic norms of the country.

BJP is already hollering for Mr. Chidambaram's exit. Perhaps they do not like his investigations in Makkah Masjid, Malegaon, Ajmer and Samjhota Express blasts.
He is running out of luck as one after one allegation leveled against him and few of them reached different courts and once judiciary starts hearing he will in deep trouble and has to deviate most of his time to defend his cases in various courts. Still big case pending in Delhi cours regard 2G scam that has been filed and challenged by Dr Subramanya swami tole most of the TV interview will not allow him to walk free in this scam and want him to spend days in behind bars for alleged role in this scam. Now how he handle the difficulty situation of situation and self made mistakes along with face inside enemies in the government as want him oust from government. He is a lawyer and his wife too also would not much troubles him in handling and managing cases in various courts.
Good. Why has it taken so much time after the elections. really three full years for the petition to reach the preliminary hearing stage? It should now at least be heard on a day to day basis and justice not delayed any more.
if such a great and successful lawyer like PC fails to get the petition squashed, there has to be merit in the charges. Such a person cannot hold charge of a portfolio which controls elections.

What purpose would be served by disqualifying PC, now that his term as Lok Sabha member is about to end. Would disqualifying him mean that all his actions as Minister be declared null and void? What are the consequences, if in the end, his election is declared null? that will be a mockery of justice. He would have ended his term, by the time, the final verdict is out. Mr. Chidambaram should resign on moral grounds and allow law to take its own course. Continuing as Home Minister of the country, he will influence the case and will hamper the efforts to serve justice.
... This person is Home Minister of India.He is in a position to make or mar India's Internal Security. With the verdict from HC ,this person should resign on Moral Grounds and PM should hand over Home Ministry to some one else [ at least to KHURSHID , the confident of Sonia] till the court gives its final verdict.
mr.chidambarm must tender his resignation,he may approach supreme court for relief.he must come clean as he is home minister & is head of cbi,ib, & other prominent institutions.today, people has lost faith in upa govt,& may find hard to survive till 2014 loksabha election.
At one stage he was trailing & at last he was defeated..This was ensured by all of the news channels..after that we don't know what happened...They stopped the results for a while & later again they started counting & announced that PC was elected...Something is fishy...Only God knows what happened really...
The law of the land will take its own course and time. Like disproportional wealth cases, he also can request for adjournments. By the time the case is concluded, the term of the present parliament would have ended. Long live Indian justice system!
The election of Union Home Minister P. Chidambaram to the Lok Sabha in 2009 but struck down two charges of malpractices against him.
Ms.Jayalalitha, on her first visit to New Delhi after becoming the Chief Minister of Tamilnadu alleged that Sri P.Chidambaram won his elections by unfair election practices.Sri P.Chidambaram glossed over it.
This case and similar ones should be decided early. What is the point in keeping them pending till the end of the life of the Lok Sabha. High courts must have a special calendar and cases of this kind should be disposed of within the next three months. Or else, this will be one more case of failure of the judicial system to act in time.
