With more people calling for harsher punishment and speedier justice in rape cases, Tamil Nadu has become the first State to unveil an action plan for curbing sexual offences against women.
In a 13-point plan, Chief Minister Jayalalithaa on Tuesday mooted severe punishments like death penalty and chemical castration for sexual offenders through amendments in Central Acts.
Expressing grief over the death of the 23-year-old gang rape victim in New Delhi, Ms. Jayalalithaa said her government would set up fast track Mahila courts in each district to deal with sexual crimes against women, appoint women investigating officers and prosecutors to make the police probe and trial more gender-sensitive. Efforts would be made to expedite the trial by holding daily hearings.
The Goondas Act, a preventive detention law, would be amended to include sexual offenders under the Act’s purview.
Sexual offences against women would be considered grave crimes henceforth; investigation would be supervised by deputy superintendents of police. Women inspectors, or in their absence, women sub-inspectors would assist the enquiry. Superintendents of police and Deputy Inspectors General would conduct a monthly review of such cases.
IGs would submit a report in 15 days on the number of cases of sexual crime under investigation and pending in courts to the Additional Director General of Police (Law and Order).
The Centre would be requested to bring in amendments to introduce death penalty and chemical castration for sexual offenders and prevent them from getting bail till the trial is completed. The State government would bear the entire medical expenses of victims of sexual violence and assist them in their rehabilitation, Ms. Jayalalithaa announced.
Like Childline, an integrated women’s helpline would be in place with the help of service-minded individuals, activists working for welfare of women and involving trained professionals capable of handling women in distress.
Efforts would be taken to install CCTV cameras in all public buildings to easily identify those involved in crime against women.
Plainclothes policemen would also be deployed at sensitive installations like malls and women’s colleges to monitor the movement of those who harass women, said Ms. Jayalalithaa, in a statement.

Chemical castration is too minor punishment for the rapists . Raping is a heneious crime and it dehumanizes a person. Death penalty is the only punishment, that these animals deserve. Even when castrated , there is no possibility that the person cant hurt another person. Chemical castration is only a temporary solution. it works only for a small period , until the drug is effective .Also when they take a counter drug , the effect dies away. So the only punishment should be weed out such people from the society. Death punishment is the only way to get rid of these animals. Even bribe, corruption and dereliction of duty should be severely punished. What is the use of suspending people for couple of months. the moment they come again to position, it is like nurturing the cancer. These public servants should be dismissed from their jobs and imprisoned. Had the police been alert , it could have saved this life and also millions of life could be saved. Shame on govt which fails to protect.
Please don't compare European countries with India, have you guys know UK is a free sex (after 14 years) country so they are really grown up with their own western culture. India is still keeping its own civilized culture and emotion, were women are still ruled by men. Death penalty is too soft a punishment for rapists. They should be branded, castrated and set free to live in society...a walking, living example to strike the required amount of fear and awareness into potential rapists who feel they can get away with abusing women thanks to their overactive hormones.
As for worrying that women will be murdered after being raped, it happens all too often and most often the woman wishes she were dead after the violation that scars and cripples her for life.
Castration would be a fitting punishment for rapists and they should be branded with a suitable mark on their forehead so that they are known for what they have done and spend the rest of their lives atoning for their misdeed.
Ms. Jayalalitha’s proposals of castration & capital punishment are infeasible -
fraught as they are with populistic overtones and the desire to score political
points by riding the wave of popular anger. These are not measures that can be
implemented in India, nor should India as a democratic nation even consider these.
At the very least, Ms. Jayalalitha could have studied how such schemes have fared
in other countries and looked at whether India could be a candidate - considering
factors such as costs, capacity, consequences & corruption.
CAPITAL PUNISHMENT: As few as 25 countries apply the death penalty for non-
homicidal rape. They are: USA, China, Belarus, Iraq, Egypt, Jordan, Kazakhstan,
Kuwait, Kyrgystan, Lesotho.
Malawi, Mongolia, Morocco, Pakistan, Philippines, Saudi Arabia, South Korea, Syria,
Taiwan, Tajikistan, Thailand, Tunisia, Uganda, United Arab Emirates, Uzbekistan.
The only major democracy in that list is the USA.
It is sad that politicians leading the country have very less awareness of the sources of problems and spend little very little time researching/studying the problem before coming up with solutions to any. Tamil Nadu Chief Minister Jayalalitha proposing death penalty and chemical castration for rapists is an example. There is absolutely no evidence to suggest that the death penalty will act as crime prevention.
In fact, this would worsen the problem wherein, rapists after committing the crime would make sure to murder the victim due to the fear of keeping the only witness alive that could hand him the death punishment. Chemical castration is another impractical mode of punishment as we have clearly seen the recent assault on the Delhi woman primarily involved abuse with physical objects, and beating.
If the death penalty comes into play, one has to also remember that we also have our dear fathers, brothers, sons who could be send to death penalty in the future on false charges.
Is India has become one of those non-sensical countries like Middle East where culture of death rules -'tooth for tooth and life for life'? The heinous crime against the girl is totally unacceptable, but how better are we by trying to rally behind death penalty for the culprits. The issue has to be squarely addressed in a holistic manner, especially with Preventive approach and building up of a culture of love in the families, schools, public squares. No one has a right to take another person's life except the Creator who has given life.

Well this is a just a step towards diversion politics from the TN CM. The event is something sad but it would be better if she manages the affairs in the state for which she is responsible.

Why doesn't anybody talk about "prevention"? This is 21st century...are you going to only respond to crimes and violence after they have occurred? Crimes against women should be prevented. No man wakes up one morning and says, "I think I'll go rape a woman today in a bus with my buddies!". There are many behaviors in these young rapists long before the rape that would reveal problems occurring or escalating. Take all cases of stalking, ever teasing, inappropriate touching in buses and trains, and dismissive attitude towards women who complain about these issues seriously. You nip the problem in the bud. I grew up feeling outraged with men standing too close to me without my permission. I feel outraged with men who don't listen or show proper communication skills. I feel outraged at men who don't, or don't know how to, treat respectfully as colleagues, peers, bosses and friends. You are discussing how to treat extreme violence against women? What century are you in?

Why has the Capital Punishment suddenly become an attractive option? Where are the human rights activists who were campaigning against Capital punishment? Have their voices drowned in this unidirectional call for blood? There are only 25 countries where death penalty is applicable for rape - with the exception of the U.S. in that list, the geographical location of the other 24 should not come as a surprise. Do we want to follow the middle east and become a narrow minded primitive society that intrinsically increases the gender divide? Someone mentioned in the comment one of the Holy books prescribed death for rape 14 centuries ago. If we are to follow that path, its a move in the backward direction.
Why are the instances of rape less in European countries where the death penalty is not applicable? If they can do it, why cant we? We need a scientific approach to solve this problem not an emotional one.

Harsh punishment is an effective method of prevention.We cannot change the indian society even in a span of five years. Indian society will change only if the following are implemented.
1. Wear traditional Indian dresses ( men in pant/shirt & women in dupatta @ work places ).
2. Always Eat veg food except labours.
3. Never touch alcohol /cigar,tobacco.

Well, what is special about this news? Jaya is not alone in suggesting capital punishment for rape. It is the common sentiment of millions of Indians. I'd be more interested in what steps she has taken (or proposed) to make TN safer for women.
Excellent beginning. Atleast one of the politicos has what it takes to
demonstrate one's intent.
But this law must encompass any offence to women and children.
Sincerely hoped that Ms.Jayalalitha demonstrate her commitment with
tangible actions, enhanced convictions and above all safety and security
to the citizens in her State.
Along with all these measures, CM should also decide on closing TASMAC in TN - I think liquor is one important reason in turning men into animals - In the recent Delhi incident, all the men involved were intoxicated.
If TASMAC is closed and prohibition is introduced in the state, It will be an important step in ensuring the betterment of TN.
Status quo, rapists are liable to a maximum punishment of 'life imprisonment'. How
does changing this to 'death' in any way alter the situation? Do individuals actually
think of consequences before committing such a crime? and even if they do, is it
healthy for a society to function based on fear for repercussions?
Law and order is one side of the coin when you have a totally unruly population and
need force for order... and there is the other - creating a society where such crimes
would not even be thought of. I think the later is a much more desirable move than
the former.

i dont understand our sense of humanity. Why are we so desperate to kill rather than
to prevent? This is the difference between us and most western societies. no child is
born criminal. these rapists and criminals are made out of the surrounding society
they grow in. we need to use data to analyse the real cause and use the analytics to
enforce steps to prevent/reduce them drastically. Why aren't we doing that? lets try
to root out the causes which are causing the rapes? then there is no need to see the
people hanged by their families and face the society.
Most of the 13 point plan are not executable. Why chemical castration? Why NOT surgical castration? In India, women are against the interests of women.

Existing rules under Indian Penal Code "if enforced sincerly and democratically" will certainly prevent any such crime. Majority of MPs in our parliament today have criminal background. This ruling class control the law enforcing agencies tody. Can we expect any improvement in the situation even if have "stricter" rules ?
Severe punishment would be required as CM stated. But this should not be only in words, It should require stringent action without fail. This should also include police station rapes and to be included for the police women who get harrassed by superior police officers.
In my humble and honest opinion, awarding death penalty to offenders
might prove more dangerous than other types of punishments. The fear
of death and getting convicted may force the wrong doers to take life
of the victim in order to clear all traces which can lead back to
him,which otherwise, he might just do away with the crime.
In light of the recent horrific episode of the Delhi victim, I believe
the displayed cruelty of the sinners to the helpless girl must be
dealt with death. The same however cannot be awarded to all rapists.

Tamil Nadu is leader in having women in significant positions in police stations and force which is helping women approach the police in times of distress. While having stricter laws may act as deterrent, in most cases the problem is at the investigation level and filing of water-tight cases resulting in poor conviction rates. This should be rectified. Also attitude of people towards rape victims have to change which is why many rapes apparently go unreported.

TN CM's proposals is a first step but rarely these crimes are black and white, except in a small percentage of cases. Fast track courts, simple laws, stringent punishments, public cameras and helplines are never enough to prosecute all cases correctly and thoroughly. Such measures alone will not be good deterrence, but necessary and a good place to start. Most sexual criminals are repeat offenders and plan well. A national database is required to keep track. Crimes against Women and Children especially sexual in nature occur frequently and vary from harassment to groping to rape. All should automatically come under Special Victims status and handled at a different level so it is not abused either way. Women and men should have trust in overall process. Emphasis must be on prevention too. Men aged 18 and over should undergo and pass classes on treating Women and Children with dignity and respect and learn consequences as a mandatory program at educational institutions and workplaces.

I read a few days back about Singapore where they beat the criminal a specific number of sticks, say 50 or 100 depending on the crime. The stick is unbreakable, slightly loose n thin. Before using, these sticks are soaked in water to make them more effective.Marks of beating remain for 2-4 months.

Make jail sentence longer like 20 years for rape.
Life imprisonment for raping and capital punishment for raping coupled with violence and
acid throwing will be apt unidimensional. At the same time false charges should also carry
severe punishment.

Making the police 'gender-sensitive' is essential. Further, ensuring
that they actually file the FIR when we girls gets the courage to
actually approach them is also crucial. I hope the Chief Minister

Capital punishment is justified for First degree rape(Violent rape causing death / Gang rape). These type of acts will make people lose confidence on government / justice. The abysmally low rate of convictions in rape cases only means that a mere tightening of the law or the introduction of death sentences for the perpetrators of the horrendous crime will not serve any purpose. What is required is fair investigation and unstinted effort to nail the guilty and to plug the loopholes in the law. The CM's views should be taken into account.
Could something also be done about female infanticide/forced abortion and murder by fire carried out on women for not being able to settle their dowry.
In addition to having women police officers, investigators and prosecutors, it would be sensible to also have a state government level women's commission that is empowered to oversee the work of these individuals. Conversely, it would be sensible for investigators, police officers and prosecutors to report directly to the women's commission rather than their own superiors.

ruled by non UPA parties should support Jayalalitas suggestion which may translate into a

Present world's control of crimes forces stringent punishment and not by milder teaching.In view of the victim's life-long trauma and even physical disability through entire life, the rapist's punishment and its degree must not be debated and must be extreme.The rape cases are very rare in countries like Indonesia and Thailand. Changing the law to provide more stringent punishment is also equally not feasible.Educating out police is a No-No because with all the additional education our cops have such outdated mind sets
that the victims are always treated as the accused.So one may ask what will be effective.We should start off by withdrawing security

A good plan by the CM. I also venture to suggest that the state government should get out of
the business of selling liquor and implement strict regulation on the sale of liquor if prohibition
is not feasible.
Capital punishment for rape is not advisable. It should be treated as equal to criminal assault. Punishment should be different for rape and murder, otherwise criminals will kill victims.

Hope the government & police won't use these tools only to monitor
political opponents and people belong to opposition parties to take
political vendetta. Last one year's government administration has been a
complete disappointment for TN due to historical power cuts and making

Men treat women as a play-toy unless we make them realize, the cruel act in our society will be prevailing.
We need to make them aware that women are not slaves but a sword who can fight very well in all ways whether its a family life or professional life.
Technology should also be used to capture information at thana level
and make dashboards available on the police performance.Public has a
right to know how well public servants are doing.Even judiciary should
publish some details judge wise on parameters like no of adjourments
done , time taken to give a verdict , no of appeals which were upheld

Ms Jayalalitha is an able administrator, an astute political leader and has generally done very well since her election. I applaud many of the steps she has taken to improve the lives of people in Tamilnadu.
That being said, I have to respectfully disagree with the suggestion that we impose the death penalty for rape. As a woman myself, I understand how grievous the crime of rape is. However at a time when more and more countries are leaning towards abolishing the capital punishment, should we add more offenses for which a guilty person should be executed?
Life in prison without parole is the right punishment. It would give people to reflect on their crimes. The prospect of spending 20-30 years in prison will discourage people from committing this heinous crime.
Let us not play to the gallery and , play politics. Let us do, what is right for the people. By the way, why not have a referendum on this (when was the last time we had one?)
Jayalalitha's greatest contribution to humanity and she will go down
in the books of history as the only Indian Politician responsible for
the emancipation of Indian women and giving them dignity, equal rights
and security. I have been a critic of Jayalalitha for not being able
to deliver on few of her promises, but this single action has put her
above the average, corrupt (probably many men politicians themselves
were/are convicts, rapists) politician of India. Must make sure that
this law is applied to all those who are convicted, regardless of
their status or position. No law in this world makes an exception and
hope India will get to some civility.

months.moreover, very costly.why govt should spend tax payers money on criminals which is
not 100% effective.the criminal can escape or abscond after initial application of the chemical

If the govt is sincere in its decision, then surgical castration must be done which is one time
spending and will be effective deterant.
2.There should not be any age consideration, whether minor or major, young or old, should
be given equal punishment under new law.
3.death penalty must be given if the raped woman dies or commits suicide.
4.bail should not be granted to any of the offenders.
5.all offenders must be given R.I. Of 30 years so they spend their youth period in jail.

transferred to the victims without any court proceedings further by the offenders or their

A good initiative indeed. It would be even better if common people are
also included. The different localities can designate a person as a
convener who would listen to the problems faced by women and convey the
same to higher police officials. The government should ensure the
availability of such officials. Even the public can lend a hand in
tackling eve-teasing by socially boycotting such persons. This would
really act like a non violent 'social satyagraha' by them. Violence or
rage hasn't really helped in solving any problem as far as I have seen.

CCTV is a good effort, which will prevent other crimes as well.
More than the capital punishment and the chemical castration, the
community and the young people must be trained to respect the other sex.
Indian media usually plays a negative role in gender justice, that must
be regulated. Taking this incident an importunity to eradicate all the
evils against the women like dowry system.
I agree better policing, strict/severe punishments are needed for these cases, I am not sure if capital punishment is justified for a rape (it may be justified for a rape-and-murder case).
TN Chief Minister, Miss Jayalalitha, must be congratulated for her prompt measures to improve safety of women. One hopes these initiatives will not fall prey to partisan politics in the one-day-up-next-day-down electoral mandates of Tamil Nadu.
Women police officers should deal with the crime aganist women including rape. All the recommendations should be implemented without fail and should be done as fast a possible. The CM has done the good thing and it should be in letter and spirit.
It's not beyond belive that this type of crimes still happen in a so called educated, a fast growing and world's largest democratic country like India. Every year thousands of women being molested and raped in India without anyone giving a damn care about it. Most of the rapes happen in villages where Dalit women become target of upper cast wealthy hindu men and cases never go reported. I am not critical of police only, even in civilised countries sometimes police action is biased but do you think these so called Indian journalists, educationist and reporters are honest and selfless to report these cases? Noway, in India castism still prevail although in a different way, you can call it more clever and dangerous way of casteism. We all call ourselves civilised, but are we?
Tomorrow, If it will be known that the victim of delhi rape belongs to a Dalit family, do you think all these agitations will be continued? Do you think Mr. Manmohan Singh or Sonia Gandhi will treat this case in same manner?
I think every girl who being harrassed, tortured or raped is 'Bharat ki Beti' and every woman who being misbehaved, tortured and tormented is 'Bharat ki maa' but I know these slogals are just too emotionals for Indian populations and politicians.
Sonia Gandhi needs to run a party, Manmohan Singh needs to run a country with MPs and most of those MPs have RAPE, TORTURED, ARSON, CURRUPTIONS, MURDERS, HARASSMENTS, ABDUCTIONS ETC ETC ( sorry, I am not a criminal lawyer to give you all terms) cases pending against them.
What Police force can do when judges are currupt? Blaming Indian police only is not the solution, Indian police is not more than a 'CHAI WALA GUY' in indian political arenas. Let DGs and ADGs make strong statements in media but they know very well where they stand in Indian politics.

I have seen Delhi ADG on TV making his eyes bigger and bigger when he said India Gate is blocked by agitators and that's his main concern, not the life of indian public. No law will make any difference untill you learn to respect the law. And in India law makers are the ones who break the law first.
When we can appreciate the initiative taken by TN CM, how far will be on paper, how
far will be to the benefit of the targeted persons is to be seen in coming days. It is
not to belittle her efforts, but we have seen so many available laws adoring the
books with no solace to people.
I, for one welcome the gesture of setting up Mahila courts for prosecuting cases which involves crime against women.
The amendment to Goondas Act seems a bit stretched, since it can be abused like POTA.
A Very welcome move by the Govt. In addition judgement timeline should be defined for such cases, so that the accused does not escape / alter the proofs. All public transport buses, autos, taxis, share autos, school and college buses should be fitted with CCTV cameras and GPS devices to crack down criminal cases. All blinders, curtains, screens etc in share autos & buses should be eliminated. Police patrolling in designated routes should be done regularly. TN should stand as an example for protection and freedom of women.
I welcome the suggestions of the Tamil Nadu CM. It is worth mentioning that in an analysis conducted by UN about women and development,it was found that involving women in decsion making process on areas that have exclusivity to feminism, would yield double dividends. It would also improve their standards and respect in the society. The Chief Minister herself a woman should be appreciated for the drive and initiative taken to protect and make women of Tamil Nadu feel safe and secure. Tamil Nadu is relatively calm but anything untoward like these can occur without notice. Wise is the person who learns from others mistakes.
In the meeting on Jan 04 with Home Minister, the TN Chief Secretary and State Polic Chief would carve a niche if participate with an intent on safety of women. There is no room for centre state relations in this meeting and that should be the last thing in their mind.
Most welcome. The late MGR, in his own production NADODI MANNAN would have his minister read out his new orders, which included CAPITAL PUNISHMENT for those convicted of rape. Further, the King's pardon, available for all convicts, will NOT be available for a rape convict. In fact the minister will read out a big list of reforms, both civil and legal and the present Government may perhaps do well to study them all now.
Welcome the bold step! But it should not just remain on paper. State should issue directives to relevant departments to secure cooperation or compliance for the effective implementation.

Very commendable indeed! Sadly this will prove to be insufficient in the long run. One of the main catlyst that triggers events leading to rape is Liquour. But, the Chief Minister is silent on this very important factor which throws the perpetrator off his sense before he commits rape. The CM's silence on Liquour is because the satanic drink is a great money spinner for any government. I therefore see no difference between drug lords and our governments which allow free flow of liquour in their states. Secondly, I believe Rape should come under Terror class of crimes and anti-Terrorism laws should be applied on perpetrators.
These things should have been done long time ago....
