High Court rejects welfare workers’ review plea

July 03, 2012 03:11 am | Updated 03:11 am IST - CHENNAI:

The Madras High Court on Monday rejected a plea by the Makkal Nala Paniyalargal (MNPs) seeking permission to file an application for a review of its order of April 26 this year relating to payment of five months’ salary as a one-time payment.

Earlier, the State government had submitted that it was ready to pay five months salary to the workers. Counsel for the MNPs associations agreed for the same. Following this, a Division Bench comprising Justices Elipe Dharma Rao and M.Venugopal said that without going into the merits, it was treating the appeals as closed.

The appeals were filed by the government challenging a single Judge’s order allowing the petitions filed by MNPs and quashing a G.O. of November 8 last year disbanding MNPs posts. In a review application, the Tamil Nadu Makkal Nala Paniyalargal Munnetra Sangam, represented by its president and general secretary, T.Mathivanan and T.Rajendran said fresh elections were conducted for the association on April 3 and new office-bearers were elected. The former general secretary, M. Palani, without getting the permission of the executive committee or the general body, suo motu had made a suggestion before the court to accept five months salary as compensation as a one-time settlement. He had compromised the case.

The Bench said that it saw no reason to grant leave for filing the review. Hence, it was dismissing the prayer. If the petitioners had any grievance against Mr.Palani, it was for them to take appropriate action as per law.
