Cong. to move HC over FIR against Rahul

A combative Congress on Tuesday asserted that it will move the High Court seeking quashing of the FIR lodged against Rahul Gandhi for alleged violation of poll code, saying the action was taken at the behest of Chief Minister Mayawati.

“Because of the successful election campaign of the Congress, this action has been taken on the direction of Mayawatiji,” Congress general secretary Digvijay Singh told reporters here.

“We will go to the High Court to get the FIR quashed. I also want to clarify that we haven’t received any notice regarding violation of Model Code of Conduct,” he said.

The FIR was lodged against Mr Gandhi by the district authorities which said his road show here had breached the time limit and the route map set by them.

District Magistrate Hari Om said the FIR has been filed against Rahul and city Congress chief Mahesh Dikshit who have been booked under Section 188 of IPC for violating prohibitory orders (Section 144) imposed in the city and under Sections 283 (danger or obstruction in public way) and 290 (public nuisance).

“The district administration had allocated time till noon and fixed a 20-km route for Rahul Gandhi’s road show but he violated it and stretched it beyond permitted time. He also did not stick to the prescribed route for the event,” the DM said.

The DM said the roadshow organisers had sought permission for a 38-km stretch and they had been informed about the conditions. The district administration had fixed a 20-km route for Rahul Gandhi’s road show since Shivratri was being celebrated and there could be traffic problems.

“There has been no violation of the model code of conduct,” Mr. Singh said adding, “we have neither received any notice nor has anybody registered any opposition to it. Only the district administration has registered an FIR against Rahul for violation of Sec.144 CrPC.”

Mr. Singh refuted the opposition charge that Congress was undermining the authority of the Election Commission.

“I want to clarify that Congress party respects the esteemed Election Commission. And I want you to recall that whatever rights the poll body has got, it has been done during the Congress rule,” he said.

In Lucknow, addressing a press conference, Union Minister Kapil Sibal said the district administration had given permission for the road show on February 17 but had withdrawn it at the last minute on the night of February 19 when all the arrangements had been made.

“Everybody knew about Shivrathri. If the district administration was so concerned, it should have acted on time,” he said.

PCC chief Rita Bahuguna Joshi, who was also part of the roadshow, denied there was any violation of the model code of conduct and accused the district administration of trying to stop Rahul’s mass contact programme at the behest of Mayawati government.

“The party has apprised the Election Commission about the action of the district administration,” she said.

Congress spokesman Abhishek Singvi said “there is no question of any illegality. Legitimate campaign is a fundamental part of free democratic right.”

Mr. Gandhi had written to the authorities that he was conducting neither a procession nor a rally in Kanpur and he was only doing a ‘Jan Sampark’ programme.

“After that, a letter was sent today but there was no response from the authorities. Hence, Rahul Gandhi started his mass contact programme. Thereafter, it was not possible to change mid-stream,” he said.

Yash, The district administration has approved for the Road Show on the 17/02/2012. Without issuing any notice to the Congress Party they withdrwan the approval in a short notice, stating the shivratri Festival on 20/02/2012. When District administration is known to Shivratri Festival, whey they approved for the Road show of Rahul Gandhi. That is the question raised by the Congress Party. Therefore, I am of the opinion, District Administration on wrong, the FIR may defenitely squashed by the high court.

This is the alarming situation in India where one wants to win the election but never wants to follow the code of conduct. How can we trust these politicians then? Rahul Gandhi and the Congress has violated the EC's code of conduct several times but eventually they refuse the charges with one line (actually lie) that "We respect EC". How Indian citizen will get motivated to abide by the rules when the Gangotri of politics itself is polluted?

Every one is equal under the grounds of law. Law should n't be politicied. Now a day's most of the politicans are distracting the law,as it is in there pocket. Tamilnadu is the best example, where we can see so many people, who never cares about law.

Congress's decision to move HC is unexceptionable, BUT its attack on the DM, suggesting that the action was taken at the behest of "Mayawatiji", shows arrogance and utter contempt for civic administration.
