Soofiya Maudany, the tenth accused in the Kalamassery bus-burning case, has been remanded to judicial custody for 14 days by P.S. Joseph, the Judicial First Class Magistrate Court 2, Aluva, on Friday.
The court, which rejected her bail application, also ordered that the accused be sent to Ernakulam Sub Jail. It posted the case to January 1, 2010.
The court rejected the bail application of the accused as it felt that “the offences alleged are those linked to terrorist activity and if the petitioner is released on bail, it may adversely affect the investigation.”
“Though the petitioner is a woman and she needs to be given a lenient view, considering the gravity of the allegation, I am not inclined to invoke the benefits of Sec 437 of the Criminal Procedure Code,” the order said.
“It is a fact that the husband of the petitioner has been incarcerated in jail for nine years. An exasperated wife may be prompted to contact and seek the help of anyone to ensure the release of her husband. But the prosecution has come up with a well-founded allegation that the petitioner has abetted the conspiracy of waging war against the country. This is a prima facie evidence of relevance,” the order judgement said.
“Considering the very grave nature of the offence, a very detailed investigation has to be conducted and as of now, investigation can be said to be in primary stage only and new evidences in the case has propped up recently,” the order said.
The Court also ordered that the accused should be given proper medical aid and care. An approved government doctor should examine her every day and if needed, she should be given medical treatment, the judge said.
The charges levelled against Soofiya include criminal conspiracy, abetment, causing mischief by fire, extortion, causing simple hurt and criminal intimidation under the Indian Penal Code. She has also been booked under Prevention of Destruction of Public Property and Arms Act.
