State government destroyed “potentially incriminating documents with tacit blessings of SIT”
The suspended IPS officer Sanjiv Bhatt says the closure report submitted by the Supreme Court-appointed Special Investigation Team (SIT) only confirmed his long-standing apprehension that it was only working to “shield” Chief Minister Narendra Modi and other “powerful persons” from legal punishment for their involvement in the 2002 Gujarat pogrom.
In a letter to SIT Chairman R. K. Raghavan on Wednesday, Mr. Bhatt said it was “outrageously shocking” that even after his repeated requests the SIT did not issue any timely direction to the State government for preservation and production of vital contemporaneous documents, and allowed it to selectively destroy the potentially incriminating documents “with the tacit blessings of the SIT.”
Claiming that the closure report made it apparently clear that the SIT was carrying out “further investigation” even after the September 12, 2011 Supreme Court order to submit its final report to a competent metropolitan magistrate's court in Ahmedabad, Mr. Bhatt said it was done “with the sole purpose and motive of shielding Mr. Modi and other powerful accused persons from legal punishment.”
Mr. Bhatt said the SIT was not required to investigate the observations made by amicus curiae Raju Ramachandran but it deliberately did so to find loopholes in his report and demolish his remark that criminal cases could be framed against Mr. Modi for allegedly creating communal disharmony under Sections of the Indian Penal Code.
Referring to a confidential letter — quoted by Mr. Ramachandran in his report — allegedly sent by the Under Secretary of the State Home Department to the SIT Chairman four days after Mr. Bhatt had met the amicus curiae in Gandhinagar, the suspended IPS officer said the “Janus-faced policies, as well as the collaborative machinations of the state of Gujarat and the SIT under your stewardship, once again stand exposed in this overt attempt at influencing the ongoing investigation against the Chief Minister and other powerful persons.”
The June 26, 2011 letter, in which the State government claimed to have “retrieved” several e-mails of Mr. Bhatt, said: “It leaves no room for doubt that it is a systematic and larger conspiracy, through Mr. Sanjiv Bhatt, involving top leaders of the Congress party in Gujarat, vested interests groups surviving on [an] anti-Gujarat campaign and electronic and print media reporters all of whom have started final efforts to keep the Godhra riot issue [a]live based on concocted facts and Mr. Bhatt, through all of them, is trying to build up a story at a stage when after almost 10 long years the honourable Supreme Court has virtually concluded the judicial proceedings after undertaking tremendous judicial exercise and [as] elaborately pointed out in the affidavit of the State government.”
The letter, Mr. Bhatt claimed, was clear proof of the State government, which should be the prosecutor, trying to influence the ongoing investigation and shielding Mr. Modi and the other accused.
Mr. Bhatt took strong exception to the SIT demolishing his two fax messages dated February 27 and 28, 2002, as “concocted and unreliable.” He gave long explanations to justify his claim that the messages he sent as Deputy Commissioner of the intelligence branch then were real and established that Mr. Modi was continuously informed of the developing serious situation outside Gulberg Society but the Chief Minister refused to take any action to pre-empt the strike, and that the then Ahmedabad Police Commissioner P. C. Pande was guilty of dereliction despite being cautioned about the possible repercussions of the “Chief Minister's decision” to bring the bodies of the train carnage victims to Ahmedabad on the Gujarat Bandh day.
Mr. Bhatt said Mr. Raghavan, as a retired senior IPS officer, should have realised that the grounds the SIT had shown for calling copies of his fax messages concocted were not justified. He said the reasons that the messages did not bear any security classification, that they carried serial numbers different from the number allocated to the intelligence agency on these days or that the serial numbers were typed, instead of being handwritten as was the usual practice, were inadequate to declare his claims unreliable.
‘Nothing secret'
Attaching copies of some other fax messages, Mr. Bhatt claimed that all fax messages need not carry security classification by default as it was decided on the contents. The messages he sent did not contain any information of a confidential or secret nature warranting their bearing the security classification. It was a common practice in the Gujarat police to assign serial number 100 for urgently numbering out-of-sequence communications in emergency situations whenever it was inexpedient to obtain the specific number of the dispatch sequencing. His messages shown as carrying the serial number 100 and other weak grounds adduced did not mean these were created later. But the SIT was making “overzealous efforts to undermine the credibility of the messages.”
‘Outrageously shocking'
Mr. Bhatt said the fact that the originals of the fax messages could not be traced in the official records only strengthened his long-standing apprehension that the State government had been selectively destroying the potentially incriminating documents, and despite his repeatedly cautioning the SIT about such possibilities, it allowed the government to carry on with its destructive action. It was “outrageously shocking” that the SIT in its final report dispensed with the issue of “non-preservation or destruction of material documents and records” in just one insignificant sentence that the “efforts were made to locate the dispatch register and [the] fax register of state IB control room, but the same had been reportedly destroyed.”
‘Bid to destroy evidence'
Mr. Bhatt said: “It is now become increasingly clear that agencies and offices working under the control of the State government of Gujarat have conspired to selectively destroy potentially incriminating documents and records pertaining to the Gujarat carnage 2002. It is also apparent that despite repeated requests, the SIT did not make any fruitful efforts for the production and/or preservation of crucial and relevant records and thereby indirectly facilitated the process of destruction of very vital evidence. The SIT under your stewardship has conveniently chosen to ignore the fact that such acts on the part of the State government or its agents would amount to offences under Sections 120-B (conspiracy), 201 and 204 of the Indian Penal Code.”

Raghvan as CBI director should be well versed with the planning process that can be used to kill a case. But he was getting good response from the public earlier. The case being very sensitive bearing huge political tone can not be decided so easily. All relevant documents should be taken on record and rejection should not be because of original being destroyed. The conspiracy gets currency if documents are destroyed and benefit of destruction can not be given to the accused but SIT appears to have done just that. This is not correct and it tells on his reputation built in the past. Reputation alone can not help him from the cover up accusation that Mr Bhat is making. The man protests that the SIT "shouldn't have questioned amicus curie". He admits that faxes he mentions were not having correct serial etc. Then he says that since the same docs are not found with govt. therefore govt. must have destroyed them.
He may be correct but unfortunately anybody could create docs later and they for sure won't be found with the govt. and he can still claim that the govt. has destroyed evidence. Now how to believe in him? I would like to believe in him but he is giving only claims and allegations and not evidence. Also, he didn't resign immediately after that incident which he claims to have protested. He was sacked. How come?
SIT was appointed by the Supreme Court and not by Modi. It is for the Supreme Court to take further action. "Communal" riots, police "encounters" and what not-it is only the Gujarat Govt. under Modi thas has been made to answer. Other states (particularly, those under Congress party rule) have been routinely exempted, presumbaly based on the principles of selective secularism. Ironically, the secular brigade seems to be only helping Modi's popularity by constantly keeping him in the limelight.
Would someone enlighten all of us the reasons for the suspension of Mr
Sanjay Bhatt, and, secondly are there any allegations against him by the
Gujerat Government. If there are what is the progress of those
enquiries.
I am led to this thinking that either Sanjay Bhatt is a paragon of
virtue or is aggreived with the embarassment
The SIT has come out with a report that is full of contradictions and it ties itself up in binds to absolve Mr Modi. Mr Bhat is a great man to stand against the state government. People who say he is corrupt should look at the charges against him most of which are of a frivolous or vindictive nature. This person has staked his honour and life in speaking out against the government and I do not see any reason other than integrity for him to destroy his livelihood and face the threats and intimidation that he must be facing now. Mr.Bhatt, diverting his own wrong doing by issuing defamatory statements against Mr. Modi on every possible occassion. From records he never looks an honest Officer. At the time of Gujarat riots, he was not senior Officer responible for law and order. Modi detractors knowingly supporting anything against him without going its merit. A Few people fix their mind beforehand and if it is not going similar way ,they start saying foul play that is what happens against special investigation team. Modi detractors knew that this is the only sensational issue that can corner him. News papers should restrain from giving much impportance to people like Mr.Bhatt.
There was a recent report in The Hindu that Gujarat government has done a very good job in bringing literacy among SC/ST people. The whole solar panel idea to harvest energy and many more examples like that. But still it seems like they just want to get Mr Modi out from the position. No one can find corruption charges against him, so they go in this direction. Mr. Raja attends parliament meting the day after he is released and no one is shocked or outraged.
It's amazing to see that how this person Mr. Bhatt is making so much news and getting an exceptional coverage from Print & Electronic Media. Especially a section of Journalists & NGO's are running a Anti-Modi campaign & keep it alive all the time. Mr. Bhatt is a government official and seems to be questioning everyone and claims thinks that he's Mr. Perfect.
His motives are suspicious and nobody is even trying to question his credibility, Did the Hindu/Author of this article ever tried to question or do some fact finding investigation about this Person? It's high time that they should do something of this sort before attaching so much of importance to him before continuing Anti-Modi campaign just for political or whatever reasons!
I think Mr Butt should approach Pakistan supreme court ,that is the only

Any kind of cover up by the investigating agenices will not remove the scar from the minds of people, who believes in peaceful coexistence of societies having diversified views and belief. The government over the nearly a decade wiped out all evidences and witnesses by hook and crook through the help of officials like Mr Raghavan. If justice was to be delivered, all those cases would have been investigated, keeping the Modi government in suspended animation.

All of you who gets crazy after reading Mr. Bhats arguments fail to notice one thing. He has not answered on question on the charges made by SIT. Instead he puts fresh questions.
1) Why did he keep quiet until 2008 and suddenly came with these charges, fax message...etc? What was he doing between 2002 and this date? Why he got this sudden "Gyan" in 2008 and not earlier?
2) If indeed, these faxes has been sent by him, why can't he file them with correct serial number? The argument that it is marked as 100 does not hold water?
3)He sent two faxes one on 27 and other on 28. Agreed the first one was sent in a hurry and hence could not have the correct serial number. Can't he find out the correct serial number on the second instance at least? Is 24 hours not enough for it?
4)Why was it typed and not handwritten as was the practice?
Mr. Bhatt -first answer these questions instead of bringing new questions to SIT

Gujarat Riot, a senseless killing of innocent people regardless point of view is a scar in the modern Indian history. Now, peptrators are still raoming freely in around the state, using their powers and their agencies to destroy evidence against them and fabricate evidence infavour to them.
Sanjay Bhatt seems to love the adulation, the fame & the stature of a
crusader. When the SIT has found Narendra Modi free of guilt, why does
it bother Mr Bhatt? Agreed, he might have been one of the finest
police officers, but is his egotistic character the driving force
behind this "crusade" to nail Modi?
What the world thinks of him does not matter. What matters is - what
has Narendra Modi done, as Chief Minister of Gujarat. He has many
feathers in his cap, and these "crusades" will not matter. Mr Bhatt is
trying hard to malign Mr. Modi to satisfy his ego. That he should not
agree with legal experts about Mr Modi's innocence is appalling.
What is sadder is that THE HINDU is allowing Sanjay Bhatt to become
his mouthpiece. I respect the integrity of this newspaper, but has it
got carried away, because someone there believes Modi to be guilty?

Dear Sanjeev, first you accuse Modi, then SIT and now Raghavan! If you claim the documents/evidence were there and seem to be destroyed, why did you not keep copies of all such things and why don't you bring out all such proofs and documents in public? Why after every 2-3 months bring out 1-2 pages and claim as if you have got all the proofs? Matter of the fact shows, that, you are trying to manufacture proofs for more than a decade now, with all political support, but to no avail, simply, because - There is no proof against MODI!!!!

If Bhatt, a person who is supposed to be upholding the Law is challenging a legally established SIT team' verdict, it doesn't help us but to ask what's his Agenda is. He dancing to the tune of someone from background is an obvious statement. If we have to be mentioning Modi for one allegation, The Hindu should be printing 100 pages every day to address all proven corruptions and allegations of key stakeholders in Congress and its allied parties.
In india bureaucrats need to be given more power, instead bureaucrats are treated as slaves of mp's and mla's. What happened in gujurat is a classic example of bureaucrats acting as slaves , when police knew something would go wrong instead of taking action it waited for chief minister's approval . The only people Raghvan's SIT found guilty are Teesta setelvad & NGO's. R K Raghavan told the Supreme Court that the celebrated rights activist cooked up macabre tales of wanton killings. The irony is for every one to see.
Hats off to SIT for nailing Mr. Bhatt false charges. Ofcourse, the SC
judges who sent the trial to lower court after seeing the Amicus and
SIT reports, SIT, and Amicus (amicus has acknowledged that Mr. Bhatt
charges are influenced for political gains) ARE more credible and intelligent than any online commentator/fighters. Mr. Bhatt has gaiven
all these affidavits under oath. Legally analyzing, he will be
prosecuted soon as I dont think even Congress will come to his rescue

Mr Raghavan, an officer, known for integrity and devotion to duty par excellence, has
spent considerable time investigating the Godhra and post-Godhra happenings
and the allegations made against CM Modi, for his omissions and commissions in
handling the affair. In his considered opinion,the allegations are found to be
baseless and without any substance. Instead of accepting his report gracefully, Mr
Raghavan is being accused of of being partial towards Mr Modi and his officers by
picking out holes in the report where there are none. It is high time to put an end to
to further discussion on this subject.
What was written in the fax letter that Sanjiv Bhatt send to the chief
ministers office ? Did it talk about a huge violent crowd outside
Ehsaan jaffrey's house and the threat to his life ? Did it talk about
the absence of police force even after repeated information being send
out regarding mob build up outside Gulberga society? If yes then the
question is simple
1-What action did the chief minister take regarding the situation in
Gulberga society?
2- What time was the fax send & how long after the fax was Ehsaan
jaffrey and 70 others killed in Gulberga society ?
3- Why would the chief ministers office destroy these faxes and other
evidences if there is nothing to hide ?
Its clear as daylight that Modi is guilty but it doesnt matter because

Sanjay bhatt we are with you. The Government with all it's might will try to bury the cases. But God will be with you. What did Modi do when 67 persons were burnt alive at the housing society. Even assuming that MP Jaffrey provoked the crowd there is no justification for mass murders. Modi has utterly failed in his duty to protect all the sections of the society. he may resort to rhetorics but for the sins committed he must face god.

The supreme court should intervene as soon as possible on the basis of the openion of the amicus curie before destroying the crucial evidence including Sanjay Bhatt.Its heartening that news papers like The Hindu maintain the values of democracy on a continuing basis.
He is man of indefinite courage. Kind of a person instill pride in the idea of 'man' itself. As far as case against Modi is concerned, we all know the larger truth wheather we like to admit or not.

It would be much more credible, if Bhatt answered all the questions that have been raised about his crediblity and even some outright lies when he claimed to be in some meeting or location which were clearly proved to be not possible at all by his own cell phone location records ? His problem, is even if he had any genuine concern, without corroboration his tendency to lie and pick on battles for some proxies will be clearly noticed by anybody with some logical thinking skills. Now that his lies have been exposed, the media houses both electronic and print which gave him so much credence, shoudl now expose him and restore their credibility as well. But I am not holding my breath for that...
Till the day SIT report came to light I had highest regard for Mr.
Raghavan. I have attended his talks at Madras University and read many
of his articles in Frontline. Some of my friends who know him closely
have said he was one of the most upright and honest police officers of
Tamil Nadu. But now I suspect his honesty. Even now I don't believe he
would have defended Modi for money or some other material benefits.
But he cannot be called honest anymore. By submitting such a dishonest
report he has brought great disrepute to his otherwise unblemished
carrer. Frontline should stop publishing his articles. Something has
gone wrong with him recently. Whatever happened to his honesty? Only
Mr. Raghavan knows.
The allegations levelled by Mr. Bhatt against the SIT are serious in
nature and it deserves to be probed. The SIT and its Chief no longer
enjoy the credibility of the people. Whenever injustice is meted out
against the weak and frail, it is The Hindu which comes first to their
rescue and stand by them at all moments.
State Govt is duty bound to explain why some documents are missing? It is a commonsense that had the Modi govt given strict order to contain/control the violence, such a large number of particular community people would not have died. May be in the court of law it could be difficult to prove since he is running the govt and no one will have the guts to tell anything against Modi govt. Even the then PM, Shri.A.B.Vajpayee said that "Modi has not done Rajdharma". Modi may escape from people's court but will pay the price one day in God's court.

There is no proof of anything that Mr. Bhatt is suggesting. It is simply his word against the Gujarat Government's. It is the norm to take the word of the Government over that of a suspended IPS officer who more than likely has an axe to grind. Why was Mr. Bhatt suspended? Was it because he was a potential threat to Mr. Modi? Or was it because he was caught playing a devious political game and Congress couldn't bail him out? I am sure he was no threat to Mr. Modi and lost his job because he was busy doing things that were not a part of his job description...
Who is right, may be the time will tell. At this point I am amazed at
the courage & boldness of Mr Bhatt - one person taking on a powerful
state government. Hats off to you sir.

he any sympathy with victims he must have resigned on 28 feb,2002 and

We need to convey them message that the belief in our Judicial system has to be kept intact. People like Bhatt and his other accomplices like Seetalvad are bent upon accusing an individual who has gone through the legal system and has established his credentials.
Hence the message should be that we need to move on - this is turning out to be personal , ego based warfare being erupted in the media by Bhatt. The Hindu should not be a victim to such moves.

This is deplorable. Mr. Bhatt has weight in his claims. Once again, the SIT's biasedness stands exposed. How can someone agree to look away from the facts for such a heinous crime. Clearly, Bhatt considers himself some sort of superhuman vigilante with
a vendetta against Modi. Strict disciplinary action should be taken
against him for indulging in a concerted campaign of Modi-bashing.
