Tiwari fails to give blood sample for DNA test

Senior Congress leader N.D. Tiwari on Wednesday failed to appear at the Delhi High Court dispensary for giving his blood sample for a DNA test to establish the parentage of a young man claiming to be his biological son.

The court last month directed Mr. Tiwari, the young man, Rohit Shekhar, and his mother to give their blood samples at the Delhi High Court dispensary for the test.

The court said the blood samples would be sent to the Centre for DNA Fingerprinting and Diagnostics (CDFD), Hyderabad.

Mr. Tiwari's counsel submitted before the Joint Registrar, Deepak Garg, that Mr. Tiwari could not be forced to give his blood sample. He also sought exemption from personal appearance for Mr. Tiwari.

The date for giving blood sample has been fixed by the Joint Registrar following dismissal of the plea.

Mr. Shekhar opposed the pleas of Mr. Tiwari submitting that he was trying to wriggle out of the judicial process in an unfair manner.

He said the High Court and the Supreme Court had dismissed Mr. Tiwar's plea against making him undergo the DNA test.

The Registrar later sent Mr. Tiwari's two applications to the High Court Bench that had ordered his test.

The Bench will take up the applications for hearing on July 7.

The DNA test was ordered following dismissal of an appeal by Mr. Tiwari against an order of a Division Bench asking him to undergo the test.

While issuing directions for the test, the Division Bench said the young man would suffer irreparable loss if the test was not conducted immediately as the vital evidence for the same would be lost forever.
