Petition sought booking of a murder case against 28 policemen

Adilabad Judicial First Class Magistrate B. Mary Sara Danamma on Tuesday dismissed the protest petition filed by K. Padma and Babita Pandey, in the alleged fake encounter killing of their husbands Maoist Cherukuri Rajkumar alias Azad and journalist Hemchandra Pandey respectively.

The petition filed in May 2013 had sought booking of a murder case against the 28 policemen who had participated in the encounter in Sarkepalli forests of Adilabad on July 2, 2010.

The petition was filed subsequent to the Supreme Court accepting the final report of the Central Bureau of Investigation (CBI) giving a clean chit to the policemen who had participated in the encounter in question.

The Supreme Court had refused to allow the protest petition and said it can be filed in the Adilabad Munsif Court.

The petitioners did so contending that a murder case has to be booked against the policemen who had maintained that they had killed the top Maoist and the journalist in self defence.

Meanwhile, advocate of Ms. Padma, D. Suresh, termed the order of the Magistrate as “bad in law” and disclosed that an appeal on the order will be filed in the High Court.
