In a far reaching verdict, the rules framed by undivided AP state permitting the private medical college managements to conduct interviews for management quota seats for PG medical courses and allot 15 per cent marks for the same has been struck down by a division bench of the Hyderabad High Court.
The division bench comprising Justice R.Subhash Reddy and Justice Shankaranarayana delivered this judgment in a writ petition filed by Dr SP Shivani and four others, who have completed their MBBS course and intended to secure admission into NRI medical college, an unaided non-minority institute, for PG degree and diploma courses in the management quota for the academic year 2014-15.
They said this rule framed vide GO Ms No.93 dated July 1, 2013 provides for 15 per cent marks for interview to be conducted by the management. They contended that such rule is unconstitutional and runs contrary to merit-alone criteria especially as these are management quota seats.
The bench pointed out that one candidate who got 55 per cent marks in MBBS was awarded 14 marks in the interview and the candidate who got 72 per cent was given zero marks in the interview conducted by the management.
The HC directed the NTR University of Health Sciences to prepare a fresh merit list by taking into account the cumulative academic merit of students in their I, II and III year MBBS course aloneforward the same to the college concerned within three days.
The respondent college was directed to take steps for admission of students, as per merit order, into various PG degree and diploma courses in medicine after receipt of approved merit list from the varsity.
