Errors galore in NGT orders

Telangana State was formed in 2013, a letter was dated 30th February, 2017 and the erstwhile State of Telangana had conceptualised the project in the district of Medigadda, Sundilla, Kannepally, Goliwada and Tukkapur”, according to the National Green Tribunal (NGT) Principal Branch, New Delhi.

These are some of the factual errors found in the reasons cited by the Delhi branch of NGT which gave the interim orders restraining the Telangana Irrigation and Command Area Development Department from carrying out any construction activities for the Kaleshwaram Lift Irrigation Scheme.

In para 35 of reasons cited for issuing the interim orders, the NGT said, “From the pleading, it is manifest that the erstwhile State of Andhra Pradesh having planed (planned) the project in question abandoned it after formation of State of Telangana in the year 2013. Therefore what transpired subsequent to 2013 till now is relevant and important”. The fact is that Telangana State came into existence on June 2, 2014.

Similarly, in para 33, the NGT stated that “the erstwhile State of Telangana had conceptualised the project in the district of Medigadda, Sundilla, Kannepally, Goliwada, Tukkapur and 7 districts which are now in the territorial jurisdiction of Andhra Pradesh”. The fact is that the places mentioned are villages and not districts. Also, none of the areas are in the territorial jurisdiction of AP at present.

This apart, in para 43, the NGT stated that “Respondent No. 4 (Project proponent) was constrained to withdraw the first clearance application as also its specific forest clearance application vide letter dated 30th February, 2017 to comprehensively account for final design of the Kaleshwaram Project”. Though the month of February do not have 30 days, the date February 30 has been repeated twice in the same para.
