The Supreme Court has declined to interfere with an order passed by the Madras High Court directing the Tamil Nadu government to identify the area for the Elephant Corridor and remove the unauthorised constructions, if any, on the lands in the corridor.
A three-judge Bench of Chief Justice K.G. Balakrishnan, Justice Deepak Verma and Justice H.L. Gokhale disposed of a special leave petition on April 30 filed by a landowner challenging the High Court order.
In its order, the Bench said: “Counsel for the petitioner contends that if the proposed Elephant Corridor is established, the petitioner would be seriously affected as his land falls in that area. The petitioner will be at liberty to approach the Committee (set up by the State government), which is likely to finalise the Elephant Corridor and also would be at liberty to approach the High Court and seek intervention proceedings though the division Bench has already indicated under other proceeding that no intervention is allowed. With the above directions, the special leave petition is disposed of.”
