Social activist re-submits complaint in court

The Magistrate returned his earlier petition for want of specifics

Social activist Piyush Manush on Friday re-submitted the complaint with the Judicial Magistrate No. III A. Shanmuga Priya demanding a CB-CID probe into the alleged torture meted out to him when he was under judicial custody at Salem Central Prison and also wanted the video footage in the prison to be secured.

The magistrate had earlier returned his petition asking him to mention the name of the court correctly and also be specific to the prayer sought.

In his private complaint filed under Section 200 of CrPC read with Section 156 (3) of CrPC against the Superintendent of Prison M. Senthil Kumar, chief warden Thirunavukarasu and 20 others, he said the assault on him by prison officials were captured in the closed surveillance cameras installed in many parts of the prison, especially in the corridor and the jailor’s room.

Also, during the block inspection, video recording was done by a person in civilian dress with a handy camera. ‘Recordings of the cctv and handy cameras will show how I was assaulted by them’, the complaint said.

The complainant sought action against the Superintendent and chief warden for beating him mercilessly on July 8 and 13 and also for illegally keeping him in solitary confinement.

He wanted case to be registered under Sections 120 (b), 342, 149, 294 (b), 324, 323 and 506 (ii) of IPC against the two and 20 others.

The complaint wants the court to summon the prison officials under Section 91 of CrPC and secure the video footages.

The complaint prays the court to forward the case to CB-CID and register the FIR and investigate the case and render justice to him.

Copies of medical certificates were also attached with the complaint apart from listing out the witnesses. The complaint would be taken up for hearing on August 9.

The activist was arrested on July 8 along with two of his associates and was released on conditional bail on July 21.
