The Madras High Court on Tuesday dismissed a public interest litigation petition seeking a direction to the Election Commission to recommend to the President to countermand the Rajya Sabha elections in Tamil Nadu, scheduled for June 27.
The First Bench, comprising Acting Chief Justice R.K. Agrawal and Justice M. Sathyanarayanan, passed the order on a petition by P.G. Sathyalaya Ramakrishnan of Kilpauk here, a journalist and also president of the All Media Journalists’ Association.
The petitioner submitted that the AIADMK and CPI candidates had sufficient first preference votes, but the DMK and the DMDK candidates did not have sufficient number of first votes.
The DMK had 23 MLAs and the DMDK 29. Hence, horse trading was going on.
If this was allowed, there would be no fair election, he said.
