The Madurai Bench of the Madras High Court on Tuesday ordered issue of notice to Home Secretary, DGP, DSP Crime Branch-CID on a petition by a widow seeking a direction for further investigation by an IPS officer into alleged murder of her husband by 11 Police personnel.
The petitioner,32-year-old Hasan Ammal, also demanded Rs.10 lakh as compensation and expressed regret that no action, except suspending them, had been taken against the personnel including three DSPs, two Inspectors, SI and Constables, after registration of the case. She also wanted financial assistance for educating her children.
Justice M.Satyanarayanan admitted the petition.
She submitted that her husband Mohammed Masood was taken by the policemen from their house on November 28,2005. After she filed a Habeas corpus petition, police registered a “Man missing case” but did not take follow up action. The case was then transferred to CB-CID on the orders of the High court.
The CB-CID report said police officials -- Pratap Singh, Chandrapaul, Easwaran, Lakshmanan, Satyaraj, Rathinaswamy, Muthu, Stephen, Basker, Michael, Mohamed Ali were the accused in the torture and murder of Masood. The CB-CID filed charge-sheet against them even without completing the investigation and tracing his body, she alleged.
Subsequently the enquiry report of the Revenue divisional officer said the eleven were responsible for her husband’s death. She alleged that two accused were promoted.
She said her husband was taken into custody in connection with the “hijacking” of a car, though some other person was involved, and he (husband) was actually forced to get off the car on the way to Nagercoil on Nov. 27, 2005.
