Law officers appointment is govt.’s prerogative: HC

Says cannot interfere in government’s administration

Noting that the appointment of law officers is in the domain of the State government, and that the court cannot interfere in it, the Madras High Court has disposed of two Public Interest Litigation (PIL) petitions moved to regulate their appointments.

“The plea is not maintainable as a PIL petition. It is up to the government to frame rules in line with the directives of the Supreme Court,” said the First Bench of Acting Chief Justice Huluvadi G. Ramesh.

Disposing of the PILs moved by advocate V. Vasanthakumar and others, the Bench made it clear that the petitioners are at liberty to approach the court if there are any violations in framing the rules, but it can be done only under the writ jurisdiction of the High Court and not through a PIL.
