Judges recuse from hearing Kudankulam violence case

A Division Bench of Justices P.P.S. Janarthana Raja and M. Duraiswamy recused themselves from hearing a couple of public interest litigation petitions filed at the Madras High Court Bench here on Wednesday with a plea to order a judicial probe into the pitched battle between the police and anti-nuclear protesters at Idinthakarai and Kudankulam in Tirunelveli district on Monday.

The judges ordered the High Court Registry to post the matter before some other Division Bench as one of them (Mr. Justice Duraiswamy) was part of another Bench which gave a green signal to the commissioning of Kudankulam Nuclear Power Project, subject to periodic supervision of pollution level, while disposing of a case filed in the Principal Seat of the High Court in Chennai on August 30.

Apart from a judicial enquiry, the present PIL petitioners had also sought compensation to all those who were injured in the violence.
