The Commission of Inquiry constituted under Justice A. Arumughaswamy by the Tamil Nadu government would inquire into the circumstances leading to the hospitalisation of former Chief Minister Jayalalithaa and treatment provided to her till her death on December 5 last year and would submit its report to the government within three months.
Scope of inquiry
According to a G.O. issued on Monday, the government “has decided that there should be an independent enquiry” into the death of Jayalalithaa and the Governor has appointed the single-member Commission of Inquiry under Justice A. Arumughaswamy.
The “Commission will complete its inquiry and submit its report (both English and Tamil) to the government within a period of three months from the date of the publication of this notification in the Tamil Nadu Government Gazette,” it stated.
In another G.O. issued on Wednesday about the terms of reference, the Commission of Inquiry was “to enquire into the circumstances and situation leading to the hospitalisation of Jayalalithaa on September 22, 2016 and the subsequent treatment provided to her till her unfortunate demise on December 5, 2016.”
The terms of reference was issued by the Governor under the Commissions of Inquiry Act, 1952. As for the nature of the inquiry to be made by the Commission and other circumstances of the case, provisions of sub sections 2, 3, 4, and 5 of Section 5 of the Commission of Inquiry Act, 1952 would be applicable.
The contents of both the G.O.s were to be notified in the Tamil Nadu Government Gazette dated September 25 and 27. Jayalalithaa was rushed to Apollo Hospitals on September 22, 2016. She was under treatment for 75 days.
“In view of various information from several organisations and individuals,” the State government last month announced that a Commission would be set up to probe the death of the former Chief Minister.
