The Supreme Court on Tuesday directed the Tamil Nadu government to implement Samacheer Kalvi (Uniform System of School Education) for classes 2 to 5 and 7 to 10 in ten days.
A three-Judge Bench of Justice J.M. Panchal, Justice Deepak Misra and Justice B.S. Chauhan dismissed a batch of appeals filed by the Tamil Nadu government and on behalf of association of matriculation schools, and impleadment application by the Tamil Nadu Anaithu Asiriyar Munnetra Peravai in support of the State challenging the Madras High Court judgment.
The Bench upheld the High Court's decision declaring unconstitutional the amendment made to the Tamil Nadu Uniform System of School Education Act to defer implementation of the USSE and gave 25 reasons why the impugned judgment should be sustained.
Writing the judgment, Justice Chauhan pointed out that even before the first Cabinet meeting of the new Government on May 22, i.e. on May 21, tenders were invited to publish the books under the old education system. “It shows that there had been a predetermined political decision to scrap the Act 2010. There was no material before the Government on the basis of which the decision not to implement the Act 2010 could be taken as admittedly the Expert Committee had not done any exercise of reviewing the syllabus and textbooks till then,” the Bench said.
“Undoubtedly, there had been a few instances of portraying the personality by the leader of political party [M. Karunanidhi] earlier in power, i.e. personal glorification, self publicity and promotion of his own cult and philosophy, which could build his political image and influence the young students, particularly in the books of primary classes. Such objectionable material, if any, could be deleted, rather than putting the operation of the Act 2010 in abeyance for indefinite period.”
The Bench pointed out that the Act 2010 was enacted to enforce the uniform education system in the State of Tamil Nadu to impart quality education to all children, without any discrimination on the ground of their economic, social or cultural background.
The Act itself provided for its commencement, giving the academic years though in a phased programme i.e. for Standards I to VI from the academic year 2010-2011 and for other Standards from academic year 2011-2012. Thus, enforcement was not dependent on any further notification.
It said, “The justification pleaded by the State that the Amendment Act 2011 was brought to avoid contempt proceedings, as the directions issued by the High Court [in the earlier April 2010 judgment], could not be complied with is totally a misconceived idea and not worth acceptance. The said judgment of the High Court was duly approved by a speaking order of this court dated September 10, 2010.”
The Bench said, “The High Court as well as this court upheld the validity of the Act 2010. Thus, it was not permissible for the legislature to annul the effect of the said judgments by the Amendment Act 2011, particularly so far as I and VI Standards are concerned. The list of approved textbooks had been published and made known to all concerned. Thus, the Act 2010 stood completely implemented so far these standards were concerned.”
It pointed out that certain directions had been given in the said judgment by the High Court which could have been complied with by issuing executive directions. Moreover, directions issued by the High Court could be complied with even by changing the Schedule as provided in the judgment dated April 30, 2010 itself.
Further, it said Section 18 of the Act 2010 itself enabled the Government to issue any executive direction to remove any difficulty to enforce the statutory provisions of the Act 2010.
The Act 2010 itself provided for an adequate residuary power with the government to remove any difficulty in enforcement of the Act 2010, by issuing an administrative order.
Quality of textbooks
On the government's stand that various representations were received about the poor quality of textbooks, the Bench pointed out that the new government took over on May 16 and immediately thereafter, the Government received representations from various private schools/organisations on May 17/18 to scrap the USSE.
“As most of these representations were made by the societies/organisations who had earlier challenged the validity of the Act 2010 and met their Waterloo in the hierarchy of the courts, such representations were, in fact, not even maintainable and, thus could not have been entertained by the Government.”

Well this verdict should be respected by all and ensure that all defects in the text books are rectified and all students have the benefit of quality education from now. The verdict is clear that all students are equal whether they study in rural or urban
very perfect and thought proving judgement .due to the result of the court we are courage to believe in democracy and we proud to be an Indian people.even after this judgement the politician must same on their deed and need.it will get rid of the difference between rich and poor.
No one is interested in increasing the standard of poor people but happy to decrease those who are having good standard. Poor cannot be made rich by making richer poor.
Whether it is a common syllabus / matric sysllabus, it shall be aimed at increasing the standard of education by inculcating Knowledge, Creativity and Analylitical skills, irrespective of the MEDIUM. Matric/CBSC schools are prefered by higher income group only to as status symbol and exposure to high social Standards. Otherwise all systems are equally good and bad, as they only inflate with data and not over all personality.
Abolishing Matric system is quiet a dangerous thing for the quality of Education in a state... Matric schools are always good in competitive & quality based education.. Abolishing Matric will loose the spirit of competitiveness in education system, which is needed for students to shine in global level... Especially this common education method will stop students from learning other languages like Hindi,Sanskrit, French, German etc.. Matric schools are nothing but the private sectors in education system... Always private sectors are needed in any field for competitiveness, Growth & Development of a nation...
Instead of improving the standard of education in Tamil Nadu, 'Samacheer kalvi' will bring down the standards even for those who can afford better education. Soon we may have a 'Samacheer Thozhil' scheme, through which the state will forbid all other professions and mandate every able bodied citizen to dig holes and fill it up.
It needed more than four years for the experts to formulate draft syllabus. They visited various States in India and one or two European countries also about mode of teaching. They invited opinions from all walks of life and various boards of education which included Matriculation,State board,Oriental,Anglo-Indian,CBSE,NCERT and many eminent scholars in respective fields. I went through the syllabus and the text books online. I spent hours and days with them and also CBSE books. I read them as a hobby. I am not an expert in all subjects especially advanced mathematics but I compared the syllabus of various streams of education.Samacheer kalvi syllabus really matched the NCERT (CBSE)books. I miss the books now as they have been removed from the web. A student of sixth standard is taught how to book a ticket in a train, what is a railway time table etc. People comment without going through the books and contents. Rote learners can secure only 60%. Logical thinking needed to score more.
only 25% of students are in Matric remaining 75% of the studnents are from State board, this verdict will definetly bring up the Standard of the 75% of student in TN. 37 years ago there was only one syllabus, now again its been brought in to same syllabus. This is good for all the studnets in rural area. If the 25% students dont want this syllabus let them study in CBSE. No one is forcing the 25% studnets to study the USSE syllabus.
If the honourable judges think that bringing a uniform education system would "impart quality education to all children, without any discrimination on the ground of their economic, social or cultural background". Why then do we have such disparity across India? Doesn't the Supreme Court represent India as a country. Why don't they recommend an Uniform Education System across India. What is the need of CBSE and a differnt education system in each states
Uniform System of School Education is a MUST. It is absolutely ok, if the quality of education, is bit of a compromise against the social equality and psychological issues of the rural school children. The quality of education could always be improvised step wise even for the same generation children. But it is important that a generation(s) of rural children are prevented living with kind of psychological complexity over the Matric/CBSC. It is a great example for the social consciousnesses. The next leap for the government is to concentrate on the infrastructure and teaching standards of the school and to enact policies and stringent regulations that ensure them.
If the prev govt had increased the state govt syllabus to that of CBSE or at least matriculation, no one one would have opposed the Samacheer kalvi. But now it has lowered the standards of all the three boards - Anglo Indian, state and Matric. A student who leaves TN to other state will definitely struggle to shine outside TN. Also TN students will find it difficult to come out successfully in competetive examinations as rightly pointed out by someone. Already the Entrance examination for getting into Engineering and medical courses is no more in TN, making the education system very dumb.
Supreme court doesn't prevent TN State Govt to upgrade the syllabus or teaching pattern to CBSE. Then why people do make too much noise against judgement. Please go ahead to upgrade the syllabus, change the recruiting procedures and do whatever you want. The samachir Kalvi concept is good, it is up to state Govt. to upgrade the standard.
We hear from'here&there' that the content of the Text Book has the Poems written by Mr.Karunanidhi & his 'Poet' Daughter?. Even SC bench in its verdict had discreetly mentioned this. Whatever the merits or demerits of Samacheerkalvi, these portions HAVE to be deleted before the books reach the hands of the Younger generation.
Judgement must be respected, after all it has passed through various appeals. Politicians must spend their valuable time in serving the people rather than focusing on ego, rivalry and revenge.
Atlast the day has come with inevitable delay. Hats off to Supreme Court for having given a crystal clear verdict over implementation of Samacheer Kalvi in Tamilnadu. No doubt, a good lesson has been taught to Government of Tamilnadu for delaying the issue for want of political reasons. Atleast now, the Government should come forward to implement the Samacheer Kalvi without further delay of time and to distribute the text books to the children on war footing arrangements to ensure its credibility over the issue.
I hope Hindu will publish the full judgement as it did earlier. I would like to understand the 25 reasons quoted by the judges. As mentioned by some others, i think the TN Govt did not represent its case ( of syllabus being of low standard ) properly. I think they merely referred to portions included in praise of D.M.K. leaders. Let us hope for the best. Anyways, as a parent, we will have to try and change our children to CBSE schools.
Now it the time for having one syllabus for the whole country. There should not be any hieararchy of school education system. Will Kapil Sibal look into it and bring the revolutionary change.
Hats off to Supreme Court for having given a crystal clear verdict over implementation of Samacheer Kalvi scheme in Tamilnadu after a proloned period of time. No doubt, the parents, teachers and children shall have a good breath atleast now. The verdict should not be treated either as a victory or a defeat to someone politically. Infact, indeed all the school going children of Tamilnadu are suffering a lot especially those who are studying in X Std without a valid text book, so far. Atlast, the day has come now! The State Government should come forward immediately to implement the uniform education system without any hesitation as already drafted well by the Committee in the interest of children of Tamilnadu. Ofcourse, if there are advantages in a new scheme, there may be many disadvantages literally which may be sorted out by the experts in the years to come.
The judges said: "Uniform education system would achieve the code of common culture, removal of disparity, depletion of discriminatory values in human relations. It would enhance the virtues and improve the quality of human life, elevate the thoughts which advance our constitutional philosophy of equal society. In future, it may prove to be a basic preparation for uniform civil code as it may help in diminishing opportunities in those who foment fanatic and fissiparous tendencies." But few critics and skeptics say that the unifom education will result in lowering of the standard and hence terming the verdict as flawed. Such views do not repesent the views of the common men/women from Tamil Nadu rural. They feel that the standard of education of rural schools will go up and the students from rural schools can compete with the urban lot at equal footing. They also expect this government to upgrade the rural schools infra and teaching staff on a war footing. Let us watch!
By lowering the standards of education and tests, Mr. M. Karunanidhi and DMK has made sure that every student gets A or 100%. This will allow them to claim that they have improved education for the masses. This will also allow them to introduce corruption in the process for admission to advance education. However, this will also have a perverse effect of depriving students from Tamil Nadu from competing in National Institutions like IIT etc. Standards in TN are already poor when compared to neighbouring AP. It is no wonder that 2 out of 3 of IIT students in south come from AP - where private schools impart outstanding education. Aside - Courts in India should stop passing laws - this is the job of legislative branch.
The Supreme court had only looked into to the political aspects of the case, but not in to the other aspects. It is absolutely short sighted judgement by Supreme Court, and also the TN government and the Matriculation schools did not represent themselves well, they did not present the case well. Now Matriculation students have to take on the syllabus which is of lower standard, globally Indian school education is rated among the lowest, please do not talk about few million people among 1.2 billion population who shine despite the pathetic education system. Instead of improving the standards of state board step-by-step, the previous government brought down the standards of Matriculation syllabus.
CM Jayalalitha's team does not have good people. Education Secretary Sabeetha IAS should have warned the Minister. School Education Minister C.V. Shanmugam has been MLA twice and was Education Minister. He is not an inexperienced person in politics. He should have known about his department. He should have also informed CM Jayalalitha of the true situation. Tamil Nadu Advocate Generall Navaneetha Krishnan was Jayalalitha's personal lawyer. After HC verdict, he should have explained to CM Jayalalitha about the merits of this case. Above facts confirm one thing what medias have been pointing. Jayalalitha does not have Ministers who can present realistic picture to her and advise accordingly. She appointed O. Paneer Selvam as Finance Minister who has no basic knowledge about Finance. The list goes on...
Supreme Court has dealt a deadly blow to the younger generations of Tamil Nadu. The students have the right to, and the Court should have upheld that right, to choose the right type of education. Had the apex court, in its wisdom, directed that the minimum STANDARD ( quality, content ) of education will be that of CBSE pattern, the younger generations of Tamil Nadu (including the rural and poor children ) would have been blessed and would shine in competititve examinations across India. I am of the view that the Supreme Court singularly failed to seize the opportunity to cleanse and upgrade the standard of education in the State of Tamil Nadu.
In a pluralistic society like ours, there is bound to be discrimiantion in the standard of education that each layer of the society gets. I fail to understand a simple logic. If there are two standards of education, then, one can only be lower than the other. So, either the lower one will have to be brought up or the other will have to be brought down. How can the students of lower standard manage if the level is enhanced mid-way through or why should the students of the higher level be deprived by bringing down their level. In this background, uniform syllabus can only be termed as too idealistic. Take for instance a child in a hamlet. For him/her, even basic education is a dream. Will it not drive away the child if the syllabus is going to be as competitive as for a urban child? Have we at least started working in bringing about uniformity in grassroot level? What if private schools have extra subjects to stay in the race? I thnik, uniform syllabus is only superficial.
THe supreme court has spoken i favour of students who have not has textbooks for the past two months.It is first blow to the government, people expected a 'revolutionary' change by voting out DMK in the elections.not this type of 'revenge'.
At last, a big respite for the common man and a severe blow for the elite private schools which are indifferent to society. Though it can be pointed out that these elite schools are superior in standards, yet it promotes discrimination.A Daniel has come to judgment.
The 3 Judges Bench of the Apex Court has taught a very good lesson to the State Government whose principles of governance seem to go for annihilation of political opponents. In a democracy, such an attitude is condemnable. Political tolerance and patience are essential for proper governance of the State. One hopes that after this judgment, better sense would prevail upon the ruling party to change its attitude towards political opponents and ensure justice, equity and fair play in governance.
The SC judgment is grossly misconceived and a serious blow to school education in TN. 'Samacheer kalvi' looks good only in principle but will be seriously flawed in practice: will create uniformity by only lowering the standards. If it is a good standard syllabus with problem oriented exams that really test student understanding (similar to CBSE), then rural schools will perform miserably. Pass percentages will plummet, resulting in a furore. If the previous govt. were really interested in imparting quality education, what prevented it from raising the pathetic standards of (i) the existing State Board (syllabus and exam pattern), and (ii)rural schools? If the State Board is of good quality, then why would the public enroll their children elsewhere? That no one who can afford a good education would choose the State Board is a telling commentary on its quality. Why force this 'samacheer kalvi' down the throats of the public? The SC judgment legitimizes a flawed politcal decision.
The State Govt must have been implemented this Uniform Education system during the Re-opening time of the Schools itself by saving those precious time of many students and teachers. As a sincere request for Politicians of the state, "pl dont play your ugly politics with INNOCENT STUDENTS LIFE any more. Other wise you'll be thrown out of power in the future elections as our generation will not tolerate these type of people who were making their life as apolitical arena.
