The Madras High Court on Wednesday quashed the order of detention of PMK MLA J. Guru under the National Security Act (NSA.)
A Division Bench, comprising Justices S. Rajeswaran and A. Arumughasamy, passed the order on petitions by Kalyani, mother of the legislator.
The Jayankondam MLA was initially detained under the Act on May 10 this year. Later a modified order was issued on October 7. The Bench directed the authorities to set Mr. Guru at liberty unless he was required in some other case.
In its order, the court observed that the main ground for the detention was a speech delivered by the legislator on April 25 this year, whereas violence erupted only after the arrest of the PMK leader, S. Ramadoss, and his followers on April 30.
Therefore, the speech of the detenu could not have been the reason for the violence that started six days after the arrest of Mr. Guru, the Bench said.
