A special court here on Thursday ordered notice to Central Bureau of Investigation (CBI) on a petition filed by A.G. Perarivalan, a death convict in Rajiv Assassination case, seeking “effective monitoring” on Multi-Disciplinary Monitoring Authority, a wing of CBI which was constituted in 1999 to probe the larger conspiracy angle behind the assassination.
In his petition, Perarivalan claimed that he would be affected by the outcome of the pending investigation by the MDMA, which was assigned to go into the larger conspiracy.
N. Dhandapani, Judge of the Designated Court, under the now-defunct Terrorist and Disruptive Activities (Prevention) Act, also directed the CBI to file its counter on October 10 after hearing arguments by both sides in camera.
CBI counsel Ranganathan stoutly argued that the petition was not maintainable and Perarivalan had no locus standi to file such a petition before the court.
Later, N. Chandrasekaran, counsel for Perarivalan, told media that the outcome of the investigation by the Multi-Disciplinary Monitoring Authority would affect Perarivalan, who was convicted for the offence of criminal conspiracy.
He said the MDMA had not conducted investigation in proper manner.
“We argued that Section 156(3) of Cr.PC empowers the court to direct the police to do the investigation properly and monitor the same. The court issued notice to other side asking them to file counter,” Mr.Chandrasekaran added.
