Coming to the rescue of a woman candidate who was denied appointment as teacher after she completed her educational courses, the Madras High Court has directed the Teachers’ Recruitment Board (TRB) to consider her case for appointment.
The TRB rejected V. Kanimozhi’s candidature citing that she had not studied the courses in the order of 10 plus 2, graduation and post graduation.
Her case was that she passed 10th standard but subsequently she failed in 12th standard. Thereafter, under the Open University Scheme, she secured B.A. degree in Tamil directly and later joined B.Ed. degree regular course and obtained that degree. Then, she secured her post-graduation degree course through regular stream.
Only after obtaining her masters, she realised that she had to pass the XII standard to become eligible for appointment as Post Graduate Assistant Teacher. Caught in this strange situation, she privately appeared and got through the plus two examinations. According to the TRB, the petitioner before joining and obtaining B.Ed. degree, did not pass the mandated plus two examination. Hence, it contended that she was not eligible for appointment.
Disposing of the writ petition, Justice S.Nagamuthu said, “It is clear that as per the law laid down by the Division Bench in J.Jospeh Irudayaraj's case, the requirements of a Government order issued in 2009 stand satisfied if the candidate has studied 12th Standard (+2) after completing B.A. degree course. Even if courses are done in reverse order, it does not matter.”
Stating that the order of TRB rejecting her candidature case was not sustainable, the Judge set aside the order of TRB and directed the Chairman of TRB to consider her for appointment as Post Graduate Assistant Teacher in Tamil, based on her marks secured after certificate verification. The court also said final orders should be passed within four weeks.
