“Centre should use Constitutional provisions against Karnataka”

December 07, 2012 12:39 am | Updated 12:39 am IST - CHENNAI:

PMK founder S. Ramadoss on Thursday said the Union government should utilise provisions in the Constitution such as Articles 356 and 365 to ensure that Karnataka released water from the Cauvery to Tamil Nadu as directed by the Supreme Court.

Article 356 relates to dismissal of a statement and imposition of President’s rule, while Article 365 says it would be lawful for the President to hold that a situation arisen in which a particular State could no more be run in accordance with the Constitution. “Rather than implementing the order of Supreme Court, which directed it to release Cauvery water to Tamil Nadu, the Karnataka government said it would file a review petition. Such an attitude is against the integrity of the country and is highly reprehensible”, said Dr. Ramadoss, in a statement here. Hence, the Union government should use provisions of the Constitution against Karnataka to get it to release the water.
