The Centre has declined sanction to prosecute M.S.Jaffar Sait, a suspended Additional Director-General of Police, Tamil Nadu, in a case relating to the alleged allotment of a housing plot by the TNHB under the Government Discretionary Quota in his wife’s name at Tiruvanmiyur here.
Mr.Jaffar Sait had challenged in the Madras High Court the proceedings before the Special Court for cases under the Prevention of Corruption Act here primarily on the ground that the Centre had not accorded sanction under Section 19 of the Act to prosecute him. He submitted that sanction was a precondition for taking cognisance of an offence committed by an IAS officer that was punishable under the Act.
When the matter came up before Justice V.Dhanapalan on Monday, an order of the Union Home Ministry dated November 29 this year was produced which said that having fully examined the material placed before it and considering all the facts and circumstances of the case, it was satisfied that no case had been made out for granting sanction to prosecute Mr.Sait and that there was not enough evidence to substantiate prosecution sanction against him. Hence, it was declining sanction to prosecute the IPS officer.
