Anticipatory bail for AIADMK candidates

April 13, 2011 02:09 am | Updated 02:09 am IST - CHENNAI:

The Madras High Court on Tuesday granted two weeks' interim anticipatory bail to B. Valarmathi and K. Kuppan, AIADMK candidates in Thousand Lights and Tiruvottiyur constituencies, in connection with police complaints against them.

Justice T. Sudanthiram said that the two would be released on bail on furnishing own bonds for Rs.20,000.

The complaint relating to Ms. Valarmathi was filed by an advocate of T. Nagar, who stated that he was threatened while seeking details about cases pending against her. On Monday, the High Court had disposed of a petition filed by the complainant with direction.

She submitted that the complainant having sent complaints on March 27, 30 and April 6, filed the petition in the High Court on April 7. This was done with the ulterior motive of spoiling her poll prospects.

The complaint against Mr. Kuppan by an Independent candidate in the constituency was that he had given false details regarding his educational qualification in his election papers. In his bail plea, Mr. Kuppan stated that the complaint was filed due to political rivalry.

Meanwhile, the Independent candidate K. Kuppan has filed a writ petition in the Madras High Court seeking a direction to election authorities to delete the name of the AIADMK candidate from the list of contesting candidates as he was not eligible to contest.

In its order, the First Bench, comprising Chief Justice M.Y. Eqbal and Justice T.S. Sivagnanam, said that it was permitting the petitioner to add Prasanna as a necessary party in the petition. It ordered notice to the AIADMK nominee, returnable in four weeks.

The Independent candidate alleged that the AIADMK nominee had engaged Mr. Prasanna of M.K.B. Nagar here to write the B.A (History) examination in his name as proxy.
