Durai alias Dayanithi Alagiri, son of Union Minister M.K. Alagiri, has filed an anticipatory bail application in the Madras High Court Bench here apprehending arrest in a case registered against him and few others by the Keezhavalavu police near here on charges of indulging in illegal mining of granite.
The petitioner claimed that the police had registered a case against him under Sections 379 (theft) and 447 (criminal trespass) of the Indian Penal Code as well as the provisions of the Mines and Minerals (Development and Regulation) Act and the Tamil Nadu Property (prevention of damage and loss) Act.
The complaint related to quarrying of multi-coloured granite over an extent of 1.21 hectares of land at Keezhavalavu village by a company named Olympus of which the petitioner was one of the directors until his resignation on April 1, 2010.
Claiming to have been a “sleeping director” of the company, the petitioner said that he was in no way connected with the day-to- day affairs of the company even when he was holding the post of director.
He alleged to have been implicated in the case with an oblique motive to harass and humiliate him.
“The petitioner submits that he is a leading business man and director of various companies. He is an income tax assessee and a permanent resident of Madurai district… If he is released on pre-arrest bail, he will not abscond and will cooperate with the investigation,” he affirmed in the petition.
He also stated that one P. Nagarajan was the managing director of the company. However, in another anticipatory bail application, the applicant S. Nagarajan (37) sought similar relief in connection with the same case and he claimed to have been the director of the company until his resignation on July 20, 2011.
