The Ahmedabad Metropolitan Magistrate on Tuesday declared that the Supreme Court-appointed Special Investigation Team had not found any evidence for prosecuting Gujarat Chief Minister Narendra Modi and top bureaucrats and police officers and recommended that the investigation in the 2002 Gulberg Society massacre case be closed.
Though magistrate M.S. Bhatt did not pronounce the court's decision on the closure report, he ordered the SIT to give a copy of it, within 30 days, to the complainant, Zakia Jafri, widow of the former Congress MP, Ehsan Jafri, who was among the 69 killed in the massacre.
In his order on a batch of petitions seeking a copy of the report, including the one filed by Ms. Jafri, Mr. Bhatt said the investigators had filed a closure report, having found no evidence to justify the filing of an FIR against any of the persons named in Ms. Jafri's complaint in the Supreme Court, accusing Mr. Modi and 62 others of direct or indirect involvement in the communal riots.
“According to the SIT, no offence has been established against any of the persons listed in Ms. Jafri's complaint. Therefore, as per the Supreme Court's order and the principle of natural justice, the complainant has to be given a copy of the report and related documents,” the court said.
No notice was needed to be issued to Ms. Jafri as she had already approached the court for a copy of the report. But the court did not make any reference to the co-petitioners who sought a copy, including the Mumbai-based Citizens for Justice and Peace, which has been helping the riot victims in the legal battle.
That the SIT had given a clean chit to Mr. Modi and others was known in official circles for some time. But it was officially being confirmed by the court for the first time.
The State government spokesman and Health Minister, Jaynarayan Vyas, was guarded in his reaction: the SIT report should put an end to the “canard” being spread against Mr. Modi and others by some NGOs in a “bid to defame Gujarat,” he said.
The SIT's finding is a shot in the arm for Mr. Modi and the BJP, given that the State is going to the polls by year-end, but is subject to confirmation by the trial court and, in case of an appeal, the Supreme Court.
Ms. Jafri said she was pained to learn that the SIT had given Mr. Modi and others a “clean chit.” She vowed to continue the legal battle.
CJP general secretary Teesta Setalvad said the report of the Supreme Court's amicus curiae, Raju Ramachandran, who had found enough grounds for trying Mr. Modi, would be crucial. “We are still not clear whether Mr. Ramachandran's report had formed part of the SIT's report…,” she said.
Tanvir Jafri, son of the deceased Congress MP, said he had apprehensions about the SIT filing a closure report. “The SIT says there is no evidence against Mr. Modi, but not the court. The SIT's decision is of no value if the magistrate decides against it. It may take time, but we are going to fight it out.”

The media has been shouting offences at this man for a decade. He has bare the brunt for too long. This should be welcome news for him. But more importantly the media should realize that in a riot, the mob rules not a leader. Politically motivated people like Setalvad etc have called him a mass murderer, and the media gave wind to those rumors, just bcz it jelled with its political agenda or it was hot news to be sold. Now that it has been proven by investigators from outside (yes nobody in SIT from guj or any sympathy for Modi). That too from a team setup by SC with members choosen by Ms Setalvad, it is only right that he be given the respect he has earned with good governance. In 2010 itself Raghavan gave modi a clean chit but after Amicus curiae has been appointed by supreme court he had to slowly change his stand. The SIT report dated 12 May 2010 said: "The Gujarat government has reportedly destroyed the police wireless communication of the period pertaining to the riots." It further said, "No records, recommentations or minutes of the crucial law and order meetings held by Modi is available but today the SIT somehow say these wireless communication are available but it fails to look into the details. The SIT used specious and illogical arguments to disprove Bhatt's testimony, despite serious disagreements of the amicus curiae. More diabolically, the SIT went out of its way to disregard a mountain of evidence presented by RB Sreekumar, who was the additional DG of the State Intelligence Bureau in 2002. The SIT report presented to the Supreme Court records how compliant police officers were rewarded while many upright police officers punished.

As long as Shri Modi don't own up the responsibility for the Gujarat Carnage, there is no way for BJP to progress beyond Gujarat. It seems no one including The Hindu believe in the Judicial system unless they get the verdict they want. Though declared not guilty, entire news is written such a way that anybody wo glances at it would think a guilty has escaped and that our judicial system is unable to deliver justice. I am not saying what is correct or not. There is a system in place to deliver justice. We all know that no such system can be perfect. In the many thousands of verdicts issued every year, many of them are definitely not the right verdict for the case. Many a time it is because of lack of proper evidice, many times suppression of evidence by the authorities, sometimes creation of evidence, and sometimes due to the inability of the lawers to present the details and sometomes because the court itself is corrupt and biased. In no such case I have seen the media taking up the issue like this. If you do not believe in the system, provide ideas to improve it, rather than haunt the one declared innocent.
As some of the other citizens of India, like myself, have pointed how this cartoon is in a bad taste, I would like to emphasize as well, if 'The Hindu' has such evidence implicating Sh. Modi why hasn't it offered the same to the SIT team, or to the court itself? Dear Writer, The picture used by you for the article is very confusing. At one side you are saying that SIT is give clean chit to Modi, on the other you are showing, with your cartoon picture, that SIT has been fabricated and its a cover up for the mass murder done by Modi. Let me remind you that SIT was created by our honourable Supreme Court to do the investigation, on whom we all have full faith, and also when there is a Congress Govt in the center, who can easily influence SIT, as the officers belong to the Central Govt. Hats off to the judgement but the real judge is god. I know it will even up some day. Something which is wrong its wrong no matter who does it and from which community he/she belongs.

Key characteristics of Gujarat 2002 riots were as follows: a) Yes, a horrible trigger (Sabarmati express) b) An established climate of hostility especially in cities like Ahmedabad, that prevailed when the riots happened. c) Planned & sustained violence at a horrible scale for a period of at least 3 weeks, against minorities. We had not seen anything like this since 1992/93. d) No noteworthy public deomonstration of remorse from Mr. Modi immediately after the events, about so many people having been killed, communities uprooted, with significant hostility in its wake. e) Sustained public baiting of minorities by Modi in the elections that followed - mocking communities with code words and derogatory phrases such as Mian Musharaf. He clearly played the communal card to drum up votes for his party to remain in power. I am not alone in thinking that there was enough smoke to at least try the leadership in a court of law.
Your newspaper must investigate independently, to find out if the SIT has conducted its investigation in a free and fair manner. If there was any cover-up or hiding / distorting facts to save someone , then it needs to be brought into public domain. The SIT report needs to be discussed by eminent people before deciding whehter it has to be accepted or rejected.

The findings of the SIT report notwithstanding, is that not the State head, who is to be ultimately held responsible for the complete failure of the state machinery as a result of which massacre of a section of the state's own citizens carried out on such a large scale? If not, then is it not that something, grave in nature, is missing in the system of governance? And if he is, then how he is to be prosecuted and what form of punishment is to be awarded to him? It was well in Mr. Modi's capacity as the state head to book the perpetrators of the Godhra Train Carnage and to ensure severest punishment for them. Even by not involving himself directly or indirectly in the riots, as made out by the SIT report, remaining a mute spectator to the ghastly events for days together points to his complicity in the matter in some manner. There have been no communal riot in Gujarat since 2002, all credit to Narendra Modi and Gujarat administration.
A plea to those who have been commenting so emphatically in support of Modi: do you really think that when violence on such a scale happens in any state, its Chief Minister, of all people, wouldn't know about it? The mere fact that such violence - mass murders, rape, loot and arson - lasted for all those days, which is clearly indisputable, shows that Mr.Modi did nothing to stop it. Wouldn't you hold him responsible for just that? Think for yourself with a clear conscience: would an SIT recommendation that 'there is no evidence' to prosecute him, automatically absolve him of his Law & Order responsibility? Moreover, the SC's amicus curiae report had recommended that Modi could be prosecuted on the basis of the SIT's own findings - and found a strange mismatch between the SIT's findings and its final recommendations. Also,clearly, the Hindu's cartoon is a commentary on the SIT report, and not on the judiciary - please read the news item properly - the magistrate hasn't pronounced yet!

I love to be Indian but I don't like the judicial system where one can go scot-free no matter how big the crime is. The manner of justice delivery under Indian judicial system makes life easy and insecure. Today one big sort can kill you and tomorrow he can be declared innocent because he/she belongs to the creamy layer of the society. My heart goes out to the victims of the Gujarat riot which was carried out in a well orchestrated and well planned manner.

What Vineeth says is absolutely correct.Modi is responsible for every
murder happened during riot as a head of state who implicitly
supported it(even if it has not been proved in court). Everyday
activities of such forces are very much evidence of their complicity
such acts. However for such acts, justice can hardly been done in courts.
Mass movement and mass education is the only option as it is clearly
visible from the comments that how learned middle class support such

Definitely, judiciary has not pronounced verdict. It has merely stated what SIT has said.

The cartoon above is a blatant disregard to the dignity and integrity of the Indian judicial process. If you have issues with the way the probe has been carried out, protest against that but ridiculing the SC appointed investigation team and indicting someone through biased opinions is plain unfortunate. The whole investigation by SIT in done under the supervision of Supreme Court. So, everyone should respect SIT's findings in Gujarat riots case. Instead of cursing the report, people should think about the time frame in which whole outcome has come. What has happened to the investigation of 1984 riots???
Well, a person can be convicted only on the basis of evidence. If the evidence is lacking, Modi needs to be given the benefit of the doubt. That's the course of the law. But it doesnt mean he is proven innocent. It's just that his guilt could not be proven. Narendra Modi must be aware to what extent he is responsible for the carnage, whether by active involvement or passive encouragement. It is quite evident that his attempt to stop the riots where either half-hearted at best, or simply absent. Remember what he remarked casually during the carnage? - "For every action, there will be a reaction". That pretty much sums up his attitude. And that too from a Chief minister who had direct responsibility to maintain law and order and protect his people. Riots are not the answer.

I am disappointed by the cartoon accompanying this story. This news report clearly states that the SIT has proven Modi not guilty. Even then your newspaper is indirectly questioning the credibility of the Supreme Court appointed SIT, suggesting that the report whitewashes Modi's alleged crimes (which never existed in the first place).

There is classical legal theory boldly enunciated in Ode massacre case recently pronounced by brave lady Judge Hon'ble Poonam Singh, namely, the victims-9 women, 9 children and 5 men had nothing to do with the burning of Sabarmati Express S-6 coach or they have not played any role there, nor there was any threat to accused by them nor accused should fear them, hence, first time in the history of riots a clear cut case was made out by the prosecution under section 120-B of IPC. Heads I win, tails you lose. This is the summary of reactions from everyone opposed to BJP and Modi. Nobody ever talked about 58 burnt alive in the train or 253 Hindus killed. Nobody ever talked about preventive arrests of 17,947 Hindus and 3,616 Muslims. Or 27,901 Hindus and 7,651 Muslims who were arrested. Nobody talks about nearly 10,000 rounds of bullets fired in police shootings that killed 93 Muslims and 77 Hindus.
All I have heard in last 10 years is 790 muslims killed in the riot with all Gujratis being termed murderers.

Teesta Setalvad of the NGO Citizen for Peace and Justice,seems to be
under delusion that he is bigger than learned judges of the Supreme
Court. The highest court of the land has covered itself with glory by
ordering the release of investigating reports to the aggrieved.
Teesta Setalvad should gracefully accept the verdict and move on
instead of cutting the nose to spite his face.
All this while, Congress, left wing NGOs and the so-called secularists along with mainstream media, used this case to run kangaroo courts against Mr. Modi. He stood the trial which no other politician in India has ever did. And now that the truth has been established after a great deal of scrutiny, I hope the humble media reconciles with him and lets him serve India and not just Gujarat. It is to the benefit of entire Indian populace that one of such character needs to be given a chance.

If nobody is guilty for the murder of Ehsaan jafrey and 70 others in
that society then who killed them ,we know there was a huge mob ,we
know the police station was nearby and we also know that Ehsaan
jaffrey called for help for almost 5 hours ,we know that even
Narendra modi knew that the Gulberga society is being attacked [copy
of intelligence report then] then why did nobody save them ,why for 5
hours they let the mob gather and finally attack and kill 70 people?
Who stopped even the police commissioner from saving them.

Modiji, now is the time to show grace in victory and be a statesman. Go
to Jafri's house with folded hands and sympathise with the widow. Ensure
that Congress and NGO don't exploite her further.
No other Chief Minister in India has suffered humiliations after the
Godhra carnage as Mr. Modi. It is heartening to note that the Gujarat
Chief Minister Narendra Modi, accused by slain former Congress MP
Ehsaan Jafri's wife Zakia of not acting against rioters, has been
given a clean chit by the Supreme Court-appointed Special
Investigation Team (SIT) in the Gulbarg Society massacre case which
took place during the 2002 riots in the state.
Further more the elections to the state assembly is round the corner
and this verdict is a shot in the arm of Mr. Modi. Hope he takes the
a national role so as to make India too a vibrant nation as he had
made Gujarat.
Foreign interest groups fanning the anti-Modi agenda may find this outcome disappointing, to
say the least. In the absence of any tangible evidence against Mr Modi, they will have to now
live with it and continue with their propaganda supported by innuendo and ongoing character
assassination! The hidden agenda is to defame him to a level that he will not become a
national leader. Many out there, would not want a nationalistic strong person such as Mr
Modi to be at the helm of India! He will prove to be unmanageable by remote centers of
power!
What matters with all these court procedures, statements etc. The media
gave a Guilty verdict long ago and is not going to retract.....
Narendra Modi has been proven innocent by the court. He should be absolved of all the allegations made out against him.
I welcome the decision of the court because it is based on unequivocal evidence and not on the perceptions of people.
Since he has been acquitted by the court of law, all the accusations against must be laid to rest.
