Sen yet to receive any communication

Calcutta High Court Judge Justice Soumitra Sen who has sent his resignation to the President, has not received any letter from the government on either the acceptance of the resignation or his appearance in the impeachment proceedings in the Lok Sabha.

“ We are waiting for some communication, in this regard”, his lawyer Subhas Bhattacharyya said. He said that he has not heard anything since the submission of the resignation , which if accepted is sent to the Law Ministry

He told The Hindu that Justice Sen has not decided whether to go or not since his 16 year old son is very sick and needs a second surgery. Justice Sen has two children a daughter and a son.

Mr Bhattacharyya said that since the resignation letter written and signed by Justice Sen has been received by the President's office, it is expected that Parliament may not proceed further in this matter.

The letter said that he was elevated as a Judge of the Calcutta High Court in December 2003 and he hereby tenders his resignation which may kindly be accepted.

The impeachment motion against Justice Sen was passed in the Upper House with a huge majority and is scheduled to come up in the Lower House on Monday.

Justice Sen has been charged with misappropriation of monies held by him as a receiver when he was an advocate in the Calcutta High Court.
